08/19/2025 Resolutions 2025-280 1 RESOLUTION 2025-280 WHEREAS, a public utility easement is required by the City of Grand Island from Hall County to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on August 19, 2025, for the purpose of discussing the proposed acquisition of a twenty(20)foot wide utility easement tract through a part of Lot One (1), Burch Second Subdivision, in the City of Grand Island, Hall County,Nebraska; the boundary of the utility easement and right-of-way tract being more particularly described as follows: Commencing at the Northeast corner of Lot One(1), Burch Second Subdivision, in the City of Grand Island,Hall County,Nebraska;thence westerly along the northerly line of said Lot One (1) on an assumed bearing of N89°33'33"W, a distance of two hundred fifteen and seventy-nine hundredths(215.79)feet to the ACTUAL Point of Beginning;thence SO°26'27"W,a distance of thirty-five and eighty-one hundredths (35.81) feet; thence S89°33'33"E, a distance of thirty-two and fifteen hundredths (32.15) feet; thence S23°56'41"E, a distance of one hundred fourteen and twenty- nine hundredths (114.29) feet to a point on the southerly line of said Lot One (1); thence N89°36'17"W, along the southerly line of said Lot One (1), a distance of twenty-one and ninety-five hundredths(21.95)feet;thence N23°56'41"W,a distance of ninety-two and thirty-five hundredths (92.35) feet; thence N89°33'33"W, a distance of thirty-nine and twenty-five hundredths(39.25)feet;thence NO°26'27"E, a distance of fifty-five and eighty-one hundredths (55.81) feet to a point on the northerly line of said Lot One (1),thence S89°33'33"E, along the northerly line of said Lot One (1), a distance of twenty (20.0) feet to the said Point of Beginning. The above-described easement and right-of-way tract containing a combined total of 3,696.66 square feet or .08 acres, more or less, as shown on the plat dated 7/23/2025, marked Exhibit "A" and attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from McDonald's USA,LLC on,over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00)and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
