06/08/2010 Resolutions 2010-150RESOLUTION 2010-150 WHEREAS, a public utility easement is required by the City of Grand Island, from Kenmare Owners Association, to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including lines and transformers; and; WHEREAS, a public hearing was held on June 8, 2010, for the purpose of discussing the proposed acquisition of an easement located in the City of Grand, Hall County, Nebraska; and more particularly described as follows: TRACT NO. 1 Part of Outlot "A" Kenmare Subdivision to ascertain the point of beginning starting at the intersection of the south line of Pioneer Boulevard and the west line of Blaine Street; thence S 00°16'58"West on the west line of Blaine Street, for a distance of one hundred twenty and sixty six hundredths (120.66) feet; thence North 88°54'01"West for a distance of one hundred three and seventy two hundredths (103.72) feet to the Point of Beginning; thence continuing North 88 °54'01 "West, for a distance of fifty two and seventy two hundredths (52.72) feet; thence North 66°36'29"West, a distance of fifty four and seventy one hundredths (54.71) feet; thence North 43°37'42"East, a distance of twenty one and thirty two hundredths (21.32) feet; thence South 66°36'29"East, a distance of ninety six and twelve hundredths (96.12) feet to the Point of Beginning. TRACT NO. 2 Part of Outlot "A" Kenmare Subdivision to ascertain the point of beginning starting at the southeast corner of Kenmare Subdivision, thence North 00°25' 10"East for a distance of sixty one and seventy three hundredths (61.73) feet to the Point of Beginning; thence South 51 °24'41 "West for a distance of seventy one and eighty five hundredths (71.85) feet; thence South 89 °07' 11 "West, a distance of one hundred seventy three and fifty one hundredths (173.51) feet; thence North 78°50'54"East, a distance of one hundred twelve and sixteen hundredths (112.16) feet; thence North 89 °07' 11 "East, a distance of fifty six and thirty two hundredths (56.32) feet; thence North 51 °24'44"E, a distance of eighty one and twenty two hundredths (81.22) feet; thence South 00°25' 10"West, a distance of twenty five and seventy four hundredths (25.74) feet to the Point of Beginning. The above-described easement and right-of--way containing a combined total of 0.123 acres, more or less, as shown on the plat dated 4/1/2010, marked Exhibit __ "A", attached hereto and incorporated herein by reference, Approved as to Form n June 7, 2010 a City Attorney NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire public utility easements from Kenmare Owners Association, on the above- described tracts of land.
