The Council met in regular session, His Honor the Mayor
presiding and all Membempresent at roll call.
The minutes of the last regular meeting were read and
apT~roved.

to the Oity of Grand Island'fbr personal inj'uries sustained result-
f tng from the condition of the sidewalk along the west side of Eddy
Street, said sidewalk having been covered with thick layers of ice,
which caused said side walk to be slippery and dangerous and that
said ice had been permitted to remaj.n on said sidewalk for more than
a week previous to~the time undersigned was injured; that said'
injury was caused by the condition of said sidewalk as above describe
the undersigned having slipped on said ice and fallen to the side-
walk, wrenching and'inj'uring his back, which has incapaci tated the
undersigned from working and which required medical treatment;
that said injuries are permanent in their nature and said injuries
were sustained by the undersigned on the 3rd day of December, 1931;
that the undersigned hereby presents clatm for the sum of $1000.

A communication from David Kaufman, Chairman of Holiday
Committee of the Chamber of Commerce, expressed the gratitude
of the Committee for the cooperation of the Mayor & Council for
the street lighting. On motion of Justice the communication
was placed on file.
The Building Inspector and Fire Chief made report of
the final inspection of the new Grand Theatre. On motion of
Knickrehm the report was placed on file.
A petition signed by Jos. A. Armatis, for a sewer to
be laid in4O'Ad<;3.Ins St., from 2nd and 3rd Street s, to the alley be-

the petition was referred to the Sewer Committee.

asking for amendments of different sections of Ordinance 1174

RESOLUTION
WHEREAS the City Electric Department has an excess surplus
of funds now on hand amounting to $122,422.50, as shown by the ~
City Treasurer's reports, and from present indications there are
no immediate large expenditures anticipated,
THEREFORE BE IT RESOLVED, that the City Treasurer be and he
is directed to transfer from the Electric Light Fund to the Paving
District Fund the sum of $50,000.00 for the purpose of retiring
and cancelling said amount of paving bonds of the City of Grand
Island, issued Dec. 15th, 1930, and it is hereby ordered that all
monies being received by said Treasurer, on said paving District
shall be applied to reimburse said Light Fund with interest at
ll"our (4) per cent per annum.

Gentlemen:
We your Committee on Sewer, find upon investigating
the condition of the Lift Station at West Lawn, (West of the
West Lawn School) that the same is not operating, has not since
its installation; we therefore recommend that same be changed to
an automatic purr~ station using two (2) four inch centrifugal
pumps, and that the firm of Black & Veatch, Consulting Engineers
of Kansas Oity, be instructed to prepare plans, specifications
and estimate for smne. The same to be nresented at the next
regular meeting of the Oi ty Oouncil, Ja~1uary 20th, 1932.

created in Adams Street from the alley between Second ffi1d Third
Streets to the alley between Third and South Front st.
On motion Of Oords the Milk and Dairy Inspection Report
for the three month period ending December 31, 1931, was to be
published in both papers at the e~pense of the Oity.

joints.

A contract of the Mathiesop Alkali Works for chlorine
was presented. On motion of Falldorf the Mayor and Clerk were
instructed to sign the contract.
A petition of Joseph O. Roney, Frank J. Alexander,
and others, asking that an ordinance be passed providing for
the elimination of radio interference was read. On motion of

Justice the petition was referred to the Ordinance Committee
in conjunction with the Oity Attorney.
The resignation of Mrs. O. A. Abbott, as a member
of the Library Board was read.
The following Resolution was presentedt
RESOLUTION
WHEREAS, Mrs. O. A. Abbott, of this City, has faithfully
served as a member of the Grand Island Public Library Board, ever
since its organization, with painstaking care and watchful attention

to the best in literature at a great sacrafice on her part of
time and effort, and
WHEREAS, the people and ci tizens of thi s City are greatly
indebted to Mrs. Abbott who has done much to build up the library,
an important factor in the education of our young people and in
furnishing wholesome literature and entertainment for all of our
citizens, and
WHEREAS, it is fitting that the City Council of Grand
Island acknowledge its recognition of the unselfish and untiring
services rendered by Mrs. Abbott, and that the Council express for
the people of this City, their deep sense of gratitude and make
public acknowledgement of all that we owe her.
THEREFORE BE IT RESOLVED in open session that the City

Council of Grand Island, express its deep and sincere appreciation
and heartfelt gratitude for the services unstintingly rendered our
people by her as a member of the Public Library Board, and that
she be made an Honorary Member of that board for the rest of her
life, which we hope will be for many years to come.

Your Committee on Streets and Alleys beg to report
in reference to the claim of George Suthers dated January 2nd,
1932, that they are unable to find any ground upon which the
claim could be allowed and recommend that the claim be disallowed
and denied because there is no liability on the part of the City
and beca~se no notice was filed as required by law and no claim
filed as required by law.

of securing the deposits of the City Treasurer of said Oity,

The minutes of the last meeting were read and approved.
The resignation of Albert Stehr, Building Inspector, was K
read. On motion of Knickrebmi the srume was accepted.
The following communication was read:
To the Honorable Mayor and Oity Oouncil of Grand Island, Nebraska:
WHEREAS, There is a strong demand on the part of the public for
the removal of the snow and, so far as possible, the ice from the
streets in the more congested area, and
WHEREAS, the city authorities are without adequate budget funds
for such purpose, and while the Ohmnber of Oommerce has a revolving
fund of $3,000 for the use of street and hj.ghway improvement in cases
of emergency; and
WHEREAS, the Chamber of Commerce has neither the authority nor
the equipment with which to do such work itself, be it
RESOLVED, by the Board of Directors of tl~ Chamber that for
the purpose of cooperating with the officials of the city, there be
hereby offered to the Mayor and Oity Council, the use of $3,000, or
as much as the Oouncil may regard as necessary, on only the one
condition, that the 'budget for the next fiscal year provide for
the return, without any interest charged, of the said $3,000, or
whatever portion of the same is thus used, the street and alley
committee to determine the district or places from which removal
be understood, however, that the return of the fund so 11sed as
already set forth, and at the time stated, is the only condition
of the proffered advance.

On motion of Falldorf the p~oposition was received and
placed on file.
Hehnke thanked the Ohamber for their cooperation, and
advised them the proposition would be kept on file, and if at
some future date it would be necessary, would call on them.
A petition signed by the Geer 00., Paul Sothman and
others asking that there be no revision in the Building Oode
at this time was presented. On motion of Knickrehm the petition
was referred to the Building Oode Oommittee.
The Sewer Committee presented the following estimate:
Estimate for Pumping Station at the Five Points
Total cost of 2 new pumps and electric motor
complete, installed for the sum of $ 3,113.00
On mption of Falldorf the estimate was adopted and the
Clerk instructed to advertise for bids to be recetved by 8 P. M.,
February 17th, 1932.
On motion of Falldorf the Engineering Department were
instructed to inspect sewer mains and latera~ as soon as possible,
and to report progress at each meeting.
The Auditing Committee presented the claims of Chas. Olark
and Clyde Hamilton for services at Koenig and Locusts streets and
M. Beekman and Glen Brown for cleaning snow from Fire Hydrants.
On motion of Hehnke the claims were allowed.
The claim of H. B. Francisco for money advanced for
removing snow was presented. Moved by Rehnke that the claim be
allowed. Falldorf called for a roll call. cords, Rehnke, Justice,
Knickrehm, Pepper and Upperman voting aye, Falldorf no, absent
Mildenstein. Mayor declared the motion carried.
The Building Code' Committee made the fO,llowing report:

urging the Oouncil to form a City Planning Commission was read.
On motion of Knickrehm the communication was referred to the
park Committee.

that the Diamond Engineering Cd. be employed to repair holes
in the asphalt streets as soon as the weather permits.

On motion of Falldorf the reports was adopted, and the
Committee given power to act wherever repairs were needed.
The Auditing Committee presented the claim of E. C.
Kammer, for doctor bills and other damages. On motion of Rehnke
the claim was referred to the City Attorney for investigation.
On motion of Rehnke the contract of C. E. Warren Co.
of Lincol~ for auditing of the water and Light Dept for the year
~93l was cancelled.
The audit to be made at the time of the
annual audit in May. The Clerk was instructed to notify the C. E.
Warren Co, at Lincoln, by registered mail, that the contract had
been annulled.
On motion of Falldorf the Clerk was instructed to
advertise for bids for a dump truck, Iton to 2 tons, for the
Street and Alley Department. Bids to be in March 2, 1932. Bidders
to furnish their own specifieat~ons.

bids for remodeling lift station, find the bid of
the Ohambers Construction Co., using Fairbanks Morse
pumps, which bid is $2,761.00, to be the lowest and
best, and we recommend that it be accepted and that
the M~ayor and Clerk be authorized to ent erinto a
contract with the Chambers Oonstruction 00.
We also recommend that the certified checks of the
unsuccessful bidder be returned at once, and that the
certified check of the Chambers Construction 00. be
returned upon the execution of the contract as above.

Bids for dump truck of Nielsen Auto Co, International
Harvester Co., and Everhart-McGuire Motor Co., were opened and
read. On motion of Falldorf the bids were referred to the Street
and Alley Committee with power to act.
Bids of Ol F. Gleisberg and Wm. Kelly Co., for Sewer
District No~ 164 were read. On motion of Falldorf the bids were
referred to the Sewer Committee.
Bid of the City Water Dept. for Water Main District
No. 70 was read. On motion of Justice the bid was accented and
the Mayor and Clerk instructed to enter into contract for the
same.
A claim of Bertha L. Kleinkauf for injuries sustained
by a fall on the ice was nresented. On motion of Falldorf the
claim was referred to the Street and Alley Committee in conjunction
with the City Attorney.

careful investigation that the management of the
Sewage Disposal Plant is one of the most important
factors of the activated sludge disposal plant,
and its successful operat!lon lies in the proper
management.
The process is complicated by a large
number of steps, each more or less dependent upon

operating to best advantage. With the marked
variation in volumne, character and temperature'
of the sewage, and the multitude of ordinary

firm of Black and Veatch, Consulting Engineers,
of Kansas City, Mo., to operate th'e new disposal
plant and the two sewage lift stations for a term
of one (1) year as per contract attached; and the

Upperman reported the bonds to be in proper form, the

ization in accordance with due notice given thereof, as re-
quired by law, that we find the total cost s of construction
of Water Main District No. 70 to be the sum of $678.34;
that the benefits accruinx to the reEtl estate in said dist-

On motion of Knickrel1rn the invitation to attend the opening game
was accepted with thanks.
A communication from Katherine Hayden proposing to sell or
rent her property to the City was read. On motion of Krehmke the
same was referred to the City Property Committee.
A petition signed by Angie Reynolds and others, asking that
a sewer be laid from College Street to Capitol Ave., and between
Park Avenue and Lafayette Ave. was read. On motion of Hehnke the
petition was referred to the Sewer Committee.
A petition and proposed ordinance was presented by the
barbers in the City regulating barbering and barber shops. On
motion of Hehnke the petition and proposed copy of ordinance was
referred to the Ordinance Committee.

WHEREAS) the Water Commissioner of the City of Grand
Island, Nebraska has made report in writing pursuant to
Ordinance No. 286 giving the n~1es of the owners of record,
with a desc~iption of the several lots) tracts and parcels
of land that are subj ect to liens under said Ordinance for
delinquent charges for water furnished by the City of
Grand Island upon and for said premises and for the owners
thereof as qelow set forth on February 1, 1932.
BE IT BESOLVED BY THE MAYOR AND CITY COUNCIL, of the
City of Grand Island, Nebraska, that the report of the
Water Commissioner certifying the several amounts that are
delinquent for water charges and are liens upon the res-
pective lots, tracts and parcels of land as hereinafter
set forth with the names of the respective owners of rec-
ord thereof, be and it is hereby approved and that (1, spec-
ial tax bearing interest at the rate of 7 per cent from
the 1st day 'of February, 1932 be and it is hereby levied

Your Commit~ee on Finance reports that it has investigated
the claim of Ernest A. Krehmke in the sum of $1500 against
the City of Grand Island which was disallowed July 6,1929,
and from the,disa11owance of which claim Ernest A. Krehmke
prosecuted a~peal. The inJury was due to a coal hole be-
ing left ope~ in the sidewalk by the City Hall while coal
was being un~oaded.
We recommend that a warrant in the sum of $200.00
payable to B+ J. Cunningham, Atty, for Ernest A, Krehmke
be drawn andidirected to Mr. Cunningham when the appeal is
dismissed at!the costs of appellant and costs are paid.

Your Cormnittee on Finance reports that we have investigated
the claim of $3ertha L. KleinkEtUf for personal injuries in
the sum of $5~00.OO and find that her inJuries were caused
from a thin f~lm of ice freezing on the sidewalk from the
water pipe dr~ining the roof of the Chicago Lumber Co on
its premises;ithat this water~out was maintained in violation
of the Building Code; that there was a thaw on January 13
of this year ~nd that water from the roof flowed on the side-
walk and froz~ during the night; that the city is not liable
and did not have reasonable time to require the sidewalk to
be cleared; that a light snow fell during the night and that
Mrs. Kleinkauf was injured the following morning; that the
Chicago Lumber Company had notice of the slippery condition
and the City ~id not; that should a judgment be secured against
the City by a:tl,y chance, the Ci ty will- have an action over
against the Chicago Lumber Company; that the Chicago Lumber
Company, know~ng the slippery condition of the walk, due to
its water spout, did not remove the ice and snow and failed
to put any sa~t, ashes, or gravel on the walk at the place
in question to prevent slipping and we therefore recommend
that the claim against the City be disallowed for the reason
stated and for other defenses which the City has to the claim.

that ~ct~on was taken thereon in September 1931; that
the Council had an audit made of the statement of
account with the Trail paving Company and that the
auditor reported that there was $837.44 due tbeCity
from the 'assignee of the Trai11 Paving Company for
balance owing to the Oi ty Light Department and that
there was $1409.25 due Mr. Kingsbury on September 16,
1931 andia balance of $166.33 on November 2, 1931,
after a+lowing the setoff due the City Light Depart-
ment in the sum of $837.44. Interest was allowed Mr.
Kingsbury in this computation at 7 per cent from the
maturity of the retainers.
We xecommend that the warrant be drawn payable to
R. D. Kingsbury pursuant to the action of the Council
taken September 16, 1931, in the sum of $1409.25, with
interest at 7 per cent from Sept. 16, 1931 and $156.33
with int~rest at 7% from November 2, 1931, and that a
"arrant oe drawn in favor of the C1 ty Light Department
in the s~ of $837.44 with interest at 7 percent from
Septembe~ 16, 1931, and that the action of the Council
of September 16, 1931, be adhered to and considered con-
clusive and final, and that the warranty for R. D.
Kingsbury be delivered to B. J. Cunningham, his attorney.

It is further recommended that bills must be
paid by ~he 16th of the month following the quarter in
which it was used in order to obtain this discount.

The Financ. and Auditing Committee presented the
claims of Joseph Shrote, goat crippled by a dog, $35.00; G. E.
McCombs, two goats ki~led by dogs, $100; and Ed Jablonski, one
goat killed by a dog,i$35.00. The claims were presented without
approval, and on motion of Behnke referred to the City Attorney.
F. C. BrO\~'n, Fire Chief, reported the hose purchased
from the Eureka Fire liose had met all requirements. On motion
of Locke the report w~s received and placed on file.
Justice reported that each time the Water Department
had gone to the home Of Mrs. Bensley,516 North BDoadwell, who made
complaint regarding h~r water bill, they had found no one at howe.
The Bond Committee presented the bonds of Gus Paulsen,
for Supt. of Cemetery, and Yosem Plumbing Co., for a plumbing license.

On motion of Krehmke the City Engineer was instruoted to
send letters to all property owners in this distriot, to asoertain
whether or not they wo~ld be willing to pay the additional cost
if the oontract was let to a local bidder, or if the oontract was
to be let to the Ohamb~rs Oonstruotion 00.
The estima~e for the drainage ditch was presented by
Behnke.
On motion ~f Behnke Black & Veatch, Oonsulting Engineers,
were instructed to prevare an estimate oovering the minimum wage,
and to inolude all wor~ that oan be done by hand labor without a
great deal of added expense.
The olaims of the City were~ on motion of Kniokrehm
allowed.

notifying the Oouncil of a change in the bus ~was presented.
On motion of Justice the communication was placed on file.
On motion of Justice a release for damages to a electrolier
by the Grand Island ~ndependent, was referred to the City Attorney
and Mr. Burdick, wit~ the authority for Mr. Burdick to sign release
on payment of the amount stated.
A letter fromG. J. Calnon in which he stated he had been
run over by a car wa$ read. On motion of Hehnke the letter was
referred to the Oity Attorney for investigation.
Notice of appeal by Raymond D. Kingsbury, for the disallowance
of claim filed December 30, 1930, was read. Appeal bond and
were
justification of sur~ty attached/to the notice of appeal. On
motion of of Behnke the notice was received and placed on file.
Notice of appeal by Bertha L. Kleinkauf, for the dUrealowanoe
of claim filed February 12, 1932, with appeal bond and just~€ication
of surety attached was read. On motion of Krehmke the n~ice of

A letter from w. T. McDonald regarding the construction
of sewer in Scarff's Addition Was read. On motion of Knickrehm
the letter was referred to Mr. Wheeler, City Engineer, to write

A petition signed by Mrs. E. R. Frederiokson, Mrs. W. B.
Hilbert and others, ~sking that aotion be taken to abate the
unsanitary condition and harboring of goats in the 300 block on
West 12th Street, was read. On motion of Krehmke the petition Was

Be it resolted that the City aocept a deed from the
Plattdeutsche Verein fro the extension of Anna Street upon

the condition t~at no special assessment shall be levied
against the property of the Plattdeutsche Verein abutting
Anna Street to be opened for the extension and opening of
the street, theiCity reserving the right to levy special
assessments in the future for paving, guttering, curbing,
sewer, water or! other public utilities, or improvements,
if any, such are made in the future.

The Water and Light Oommittee presented the following
Resolution:
RESOLUTION
Whereas, an excise tax of 3 per cent for electrical
energy for do$estic and commercial consumption has been
imposed by the government and whereas the Council by
Resolution ha$ reduced the rates on those affected by the
tax in precis~IY the amount of the tax, and whereas the
tax has not been construed by any judicial decision at the
present time,
BE IT nESOLVED, that the Light Commissioner be
instructed and directed to see that the proper claims are
made for exemptions, and that the payments of the tax be
made undex pr~test until the constitutionality of the tax
and the liabi~ity of the city to remit the tax is settled

RESOLUTION
WHEREAS, the Union Pacific Railroad Company has tendered
to the City of Grand ilsland, State of Nebraska, an agreement cover-
ing the furnishing to! the Union Pacific Railroad Company by the
City of Grand Island pf steam for heating purposes at Grand Island,
Nebraska, said agreem!ent being indentified as Union Pacific Rail-
road Company's Contract Department No. 19230; and
WHEREAS, the Council of the City of Grand Island has said
proposed agreement beifore it and has given it careful review and
cons~deration; and
WHEREAS, it: is considered that the best interest of said
City of Grand Island ~ill be subserved by the acceptance of said
agreement;
THEREFORE, !BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
GrAND ISLAND, STATE qF NEBRASKA:
That the t~rms of the agreements sub$itted by the Union
Pacific Railroad Com~any as aforesaid be, and the same are hereby,
accepted in behalf off the City of Grand Island;
That the M~yor said City is hereby authorized, empowered
and directed to exec~te said agreement on behalf of said City and
that the Clerk of sa~d City is hereby authorized arid directed to

to operate a minature !golf oourse, the license to be $6.25 for
the remainder of the season.
The City P~operty Committee made the following report:

July 20, 1932
Your Oommittee reports in regard to the condemnation
appeal grow~ng out of the taking land for the viaduct across
the Pennington land, which was cnndemned in April, 1930;
that damage~ were claimed by the Penninghtons in the sum
of $5000.00; that the case can be settled by the Penningtons
deeding to ~he city 1.116 acres of land south of the
viaduct and!a s~all strip north of the viaduct, the city's
payingfuere~or $300.00 as follows, by paying $50.00 to the
City Light ])epartment to p ay Penningtons light bill to the
City and by ,paying to the Equitable Building and Loan
Associationiand to the County Treasurer of Hall County the
balance of $250.00, the Pennington to pay their costs in the
District Court, and to dismiss the law suit.
We recommend that the proposition be accepted and that
a warrant b~ drawn on the general fund for $50.00 payable
to the City Light Department for the Pennington light bill,
and that a ~arrant be drawn for the balance of $250.00
payable to ~he Equitable Building and Loan Association and
the County Treasurer of Hall County, Negraska and be
delivered to A. G. Abbott, to deliver to the mortgagee and
treasurer , delivery of waranty deed,'.for the property and
the dismiss~l of the Pennington appeal and payment of their
cmstsby the'Penningtons as plaintiffs.

We your Committee on Parks, to whom was
referred the 'petition requesting that tennis courts be
placed on We$t 1st and Division Streets, beg to report
this piece of property has already been planted with
trees, and sJilrubs; and that it is this Committees plan
to put in a pool and playthings for the children next
spring. This Committee feels that the children should
be taken care of first, that each ward should have some
kind of a playground; and as our appropriation this year
is not large enough to take care of both playground and
tannis court$, this Committee recommends that this petition
be filed for'future reference.

Your Committee reports that it has investigated the
claim filed JUne 20, 1932 of George J. Calnan for medical
services in t~e sum of $81.00, damages for personal injuries
sustained by ~eason of being struck by an automobile. Your
Committee advises that he has a clear case of negligence
against the driver of the car, and after consulting with the
City Attorney; we are advised that the City is not liable
and recommend ,that the claim be disallowed because there is
no liability 4nd for other defenses the city has to the claim.

A proposed contract with Stove Deats, for a term of
six months commencing'August 5, 1932 was read.
On motion of Locke the report was adopted, and the
Mayor and Clerk autho~ized to sign the lease and agreement with
Stover Deats.
A report of Fire Chief Brown regarding the transfer
of the chemical tanks ,from the Stutz truck at the North Side
station, was read. On motion of Locke the report was accepted
and the report placed ion file.
Gross a~ked for further time on the petition presented
by the grocers and owners of meat markets.
The Epgineer's estimate for replacing the diagonal
sidewalks in Pioneer Bark was presented. On motion of Knickrehm

Gentlemen:
We the Police Committee of theCity Council
believe that the! efficiency of the department would
be greatly incre~sed if there was a change in the Chief
and that greater, harmony and more confidence in the
police would res~lt. This change shall take place on
or before Septem~er 1st. We would be glad to give
details of the reasons which prompt our suggestion.
This vtcany can be filled temporarily from
the force.
We al$o recommend: Dismissal of Desk Sergeant
Tumblin for the good of the service; the adoption of a
retirement age for policemen, (this age to be 65 years)
Men in service at the present time tha>t have attained
the retirement age shall have not less than 30 days notice.
However, we have 'no objections to using retired policemen
for watch men or 'similar position so long as they are
considered effic~ent to handle said position.
We al~o recommend shorter working hours, allow-
ing officers time to attend meetings for instructions and
drills, enabling ithem to render their services to the
public in the mos't efficient manner.

~quirement~ for bridges on County roads to be not
less than 1$ feet. Thebridge for Station 29 plus
39 in the c~ntract of the Diamond Engineering Co.,
for the outrall sewer ditch is only 12 feet in width.
We therefor~ recommend that a reinforced concrete
bridge inde~tical with the one for Station 82 plus
23 be substttuted and that the contract be increased
the difference in cost of the two bridges which is

RESOLUTION
RESOLVED, That all Police Officers and Firemen in "Active
Servide" shall 'go off the regular pay roll on reaching the
age of 65 years but men now employed regularly in these de-
partments, who 'are no 65 or will reach that age on or before
December 31st, 11932, shall be relieved of their duties in
"Active Service"on and after January 1st., 1933. But such
men so taken f~om Active Service maybe used for desk work,
watchman or similar work, but shall not be used in "Active
Serviee", exce~t in cases of great emergency.

On motion of Hehnke the City Treasurer was instructed to
make a list of all unpaid paving taxes which had run 2 years past
the ten year period.

The above electric rates to become effective at the November 1st, 1932
billing.
We have estimated that this recut ion will amount to approximately
$15,000.00 per year saving to City Light customers and is nade possible
by the ever increasing efficiency of modern machinery and methods of
operation which are the fruits of our efforts in the rebuilding and
addi t ions made to our ,Power Plant since 1926 and up to the present
time.
We feel that this reduction can safely be made at this time with-
out danger of handicap to t he future of our Power Plant, which has
been built and operat~~ed up to its present high state of efficiency
almost entirely out of the earnings of the Departrnent.
The services rendered by Sity Light Department are available to
all citizens of Grand Island.

adopted a new schedule of rates for electric current of
September 7, 1932) and an excise tax of three per cent

for domestic and commercial consumption,
BE IT RESOLVED that the City of Grand Island, Nebraska,
further reduce those rates fixed by the new schedule on domestic
and commercial consumption affected by the tax by precisely the
amount of the tax, and that the Light Commissioner be instructed
to bill all conSU$ers at the new schedule of rates adopted and
that he stamp on the bills subject to the excise tax that the
three per cent United States tax has been included or words to
that effect as he has bee~oingheretofore.

A communication from the Good Roads Committee of the Chamber
of Commerce calling tpe attention of the Council to the condition
Cbf the crossing of the C. B. & Q. Railroad Company at tenth street,
and the one on South Locust which has a bar missing was read. On
motion of Krehmke the City Attorney was instructed to notify the
Burlington officials ~o place same in good condition; also to arrange
for a crossing at Okl~homa Avenue.

WHEREAS, our oldest city employee, Henry O. Heath,
passed away quietly at his home in Grand Island on August 21,
1932 a,nel whereas Mr. Heath has been a fai thful) effi cj.en t
and loyal worker for the City of Grand Island for many years
as ci ty weighmaster and has been an honored and respected
citizen of Grand Island for the past forty-nine years and
has contributed to the growth and upbuilding of the city,
BE IT RESOLVED BY THE MAYOR AND CITY OOUNOIL OF THE
OITY OF GRAND ISLAND, NEBRASKA:

ing children, the sympathy and appreciation of the Mayor

The Council met in regular session, His Honor the Mayor
presiding and all Memb~rs present at roll call.
The minutes pf the last regular meeting were read and
approved.
A petition sligned by Wilbur McReynOlds, Antonino Wagner,
and others asking that: the sanitary sewer be e~tended to Blocks
5, 6, and 7 in Colle~e Addition was presented. On motion of Hehnke
the petition was refe~red to the City Engineer and Sewer Committee.
A petition ~or street light at the intersection of Huston
and Cottage Streets was presented. On motion of Justice the petition
was referred to the L~ght, Water and Ice Committee.

Rittenho-m.se called the attention of the Council to .
the quarterly b1l1ingof water users, stating that many complaints
had been made to him, !especially those who use below the minimum.
On motion of Rittenho~se the matter was referred to the Light and
Water Committee, to s~e if different arrangements couldn't be made
for the small water user.
Dn motion of Mildenstein the matter of cattle trucks
parking in the reside~tial district was referred to the Ordinance
Committee for investigation.

regarding unpaid occupation taxes, and a report'showing the
amount of RegisterediWarrants against each fund, were on the
motion of Hehnke pla~ed on file~
Three petitions protesting to the creation of water
main Districts in Blqcks, 3,12,17,4,11,18, 5,6, and 7,
1n;."Oollege Addition tio West Lawn, were presented. On motion of
Justice the petition~ were referred to the Light, Water and Ioe
Committee.
A petition !signed by Mrs. A.Earnest, Jaseph L. Erny,
and others, protesting again the creation of a sanitary sewer
district in Block 5, :6, and 7 of College Addition to We~ Lawn,

RESOLUTION.
I
WHEREAS, the Chambers Construction Company has
completed its contract with the City of Grand Island on
the seven-foot outfall sewer, which was to have been com-
pleted May l~ 1932 and the Chambers Construction Company
claims damages for being delayed by the city in the com-
pletion of its contraot, and the city has not had time to
properly investigate the merits of the claim for damages
due to the oity's delay, but the city desires to pay the
Chambers Con~truotion Company the balance due it on the
contract on the estimate of Messrs. Black and ~e.ch,
Consulting Engineers, and reserve the question of the a-
mount of damages, if any, due the Chambers Construction
Company occasioned by the city's delay, for future con-
sideration and action,
BE IT RESOLVED, that the city tender to the
Chambers Construction Company its warrant in the sum of
$ 5,129.42 for the balance due the contractor on the
completion of its contract and reserve the question of
damages due to the city's delay, for future determina-
tion and act!ion, and that the Chambers Construction Com-
pany be notixied to file i~s claim for such damages in
the usual way, and that the acceptance of the warrant
by the Chambers Construction Company snaIl not prejudice
its claim or! any right of action :it may have against the
city on account of such

On motion of Hehnke the Airway Weather Bureau telephone
was to be put back on.the City telephone list.
A communication from Mrs. Albert Etting asking that the
drill tower be removed from the stub end of Locust Street was
read. On motion of Krehmke the communication was referred to the
Fire Committee.
A communication was read from Anna Wartensleben regarding
rubbish and the leaves from trees blowing in her yard. On motion
Krehmke the communication was received and placed on file.
A claim of l. J. Echternkamp against the City in the
amount of $96.83 was read, in which he claims he struck a manhole
hole with dirt and br~ck piled hightaround it. On motion Krehmke
the clai m was di sallowed.
A communication from Jas. Nicholson, City Treasurer,

H. B. Francisco, Chief of police, made report regarding
the clearing of lots pursuant to Ordinance No. 1264. On motion
of Krehmke the reDort was adopted.
The following Resolution was presented:
RESOLUTION.
BE IT RESOLVED by the Mayor and City Council of the
city of Grand Island, Nebraska, that the report of the Chief
of Police certifying the maount of costs incurred and sums
expended in 1832 in clearing the several lots, tracts and par-
eels of lemd in the city of Grand I sland, Nebraska, of weeds,
in accordance.wi th Ordinance No. 1264 and pursuant to the ord-
er of the City Council, be and it is hereby approved and that
a special tax be emd it is hereby levied and assessed against
each of the several lots, tracts and parcels of land as set
forth in said report, respectively, for the purpose of paying
the costs and Silins of money expended in clearing the several
lots, tracts and parcels of land, respectively, of weeds and
objectionable matter, in the ewn set opposite the several des-
criptions of said lots, respectively, in said report, and that
such special taxes shall bear interest at the rate of 6 per
cent per annum from December 7, 1932. Said lots, tracts cilia
parcels of land axe assessed as follows:

The Sewer Committee made the following report:
Dec. 7, 1932
To the Hon. Mqyor & City Council:
We your Sewer Committee recommend that
the claim for damages against the City of Grand Island filed
by the Ohambe~s Construction Company be allowed in the sum
of $1,310.60.
The Chambers Construction Company was
ordered to stan operation o~ the Outfall Sewer Ditch on May
1st, 1932, ancf th-ey were held from completing this contract
until October '1st, 1932. The reason for this delay was that
the Oity was ~nab1e to complete their drainage ditch to Wood
River until that date.
, On account of this delay the Chambers
Construction Qompany filed a claim of actual expense on
account of sanie amounting to $2,320.55.
By mutual consent of both parties
concerned the iSum of $1,310.00 was agreed upon as a final
payment for all damages incurred.

The Council met in regular session, All members present
except Locke who was excused.
Minutes of the last regular meeting were read and approved.
Agreement and ~esolution with the Union Pacific Ra.ilroad Company
to cover the furnishilng of ice was read.
On motion of Justice the
Resolution adopted a:n;d the agreement accepted.
An agreement and Resolution covering the laying of a 12 inch
water main under the :tracks of the Union Pacific Railroad Company
in Cedar Street was r'ead. On motion of Justice the Resolution was
adopted and agreement accepted.
The Light & Water Committee made the following report:

as read.
Ordinance No.i447 was presented, levying special water
district taxes for Water Main District No. 71. On motion of Knick-
rehm the ordinance was placed on its first reading. Motion carried
on roll call, Gross, Rehnke, Justice, Knickrehm, Krehmke, Mildenstein,
and Rittenhouse voting aye, nay none. Locke excused. The ordinance
was read.and declared passed its first reading.
Moved by Krehmk~ that the rules be suspended and the ordinance
placed on its second teading by title. Carried on roll call, Gross,
Behnke, Justice, Knickrehl} Krehmke, Mildenstein, and Rittenhouse
voting aye, nay none, Locke excused. The ordinance was read by its
title and declared pa$sed its second reading.
