Be it ordained by the Mayor and City Council of the . C it;y of Grand Island, He bras h1 : Section no. 1. That all property owners within a newly created paving district vmo derive their water and sewer service from mains laid in the streets proposed to be ptiveCl 1:\1it11in such paving clistrict, are hereby required to la.y service pipes and sewers from the street to the curob line and connect same wi tl:1 the we.ter and sewer main in said street before the surface of such street is paved, macadamized, or graveled, and wi thin the time hereinaf.ter provided. Section l~o. 2. In the event any such property owner shall fail or neglect within "the time hereinafter provided to lay such service pipes or connect up with the water and sewer mains in such street, before such street is paved, macadamized, or ~ graveled, the City of Grand Island is hereby authorized and required, after due notice given as required by law, to lay such service pipes and connect the same vV'ith the water and se\ver mains in said street, ancl the cost of such extension, connection, and improvement is hereby made assessable as a special tax against " bl3 the property contained in said district and benefitted thereby. Section No.3. Tha t all public service and utili ty . companies having mains within the streets in a newly created paving district are hereby required, after notice given as hereinafter provided, to lay service pipes from their mains in said street to the curb line for the use of all abutting property owners wishing to connect up with the same in the future before the surface of such street in such paving district is paved, macadamized, or graveled. Sec tion H o. 4. That the Oi ty Clerk is hereby instructed, after the organization of a paving district is complete, to publish a notice, in a legal newspaper published in the Oi ty of Grand Island, and directed to the property ovr.ners wi thin said district, and to publiC service and utility companies having m<:;t.ins within said streets or "vishing to lay mains in said streets for future use, for a period of 5 days, advising . said prop erty owners and pub 1ic serv ice and utili ty companies of the provisions of this ordinance. That said service pipes and sewers must be laid and connections made with the mains and sewers in 1 as t such street within 30 days from and after the &~~ publication of the notice provided for in Section No.4 hereof. S ec t ion No.6. That it is hereby declared unlawful for any person, firm, corporation, or contractor to disturb the surfact of any paved, macadamized, or graveled street or all9yfor th e purpose of laying servi ce pipes or sewers for any person or persons or public utility corporation, failing to comply with Sections 1, 2,3,4, and 5 of this ordinance. Section No.7. It is hereby declared unlawful for . any person, firm, corporation, or c'ontractor, whether operating unde r franchise or con tract or not, to hereafter disturb or do any vwrkof cons true tion , reconstruction, or repair within any street, alley, or public hignway within the corporate limits of the Ci ty of Grand Island, requiring the disiur-bance of any paved 614 . . . 615 Section I~o. 11. Section Ho. 12. vmenever a leakage of water or gas shall be discovered in any paved street or alley, the City Engineer shall notify thel'later Comrnissioner of tihe City of Grand Island, or the Gas Company of such leakage, ancl it shall thereupon 'be their duty to shut off the water or gas from such defective pipe or condui t, and if a defec t shall be found to exist in any pipe belonging to the city on gas company it shall be their duty to take . out a lJermi t for the necessarY' work and to immediately rep<-1ir such defect, and thereafter, as hereinbefore provided, the city shall restore the paved surface at the expense of the person, firm, or COrlJOration owning the water or gas main. If a defect shall be found ti exist in a pirJe or conduit belonging to a patron of such supply mains then the work shall be done at the expense of such ovmer, and no water or gas shall be turned on to such service until ordered in writing by the City En.gineer, which shall only be done after the cost of repairs and restoration of the paved surface shall be paid to the City rrreasurer. Section No. 13. The permits furnished by the City Engineer ffilall be on card~, each card shall be consecutively numbered, and shall contain the nmne of the party authorized to use the same, . ;:' and th":e time limi t within which the same may be used, e,nd the location and. nature of the work to be done . . . . 616 Section No. 14. Any person, firm, or copporation having paid to the City Tre$"surer the estimated cost of such rep air or reco nstruc ti on shall be en tit led to a refund of the difference between the estimated cost of repair and the actual cost of the same, by filing vvith the Cit;y Clerk a claim for the exact amount, duly certi fied to by the City Engineer. Section No. 15. Nothing contained in Sections '7, 8, 9, 10, 11, 12, 13, and 14 of this ordinance ~lall be construed to apply to the City of Grand Island. Section No. 16. Any person, comparlY, firm, or oorporation who shall fail, neglect, or refuse to comply with, or violate any of the requirements or provisions of Sections 6 to 15 of this ordinance shall be deemed guilty of a misdemeanor, and on the conviction therefor sli...all be fined in any sum not less than five nor more than one hundred dollars for each offense, and if the guilty party be a licensed drain layer or plumber, his license may be declared forfeited. Whereas, the Mayor and City Council of the City of Grand Island, Nebraska, find that the steps heretofore taken for the creation of Sewer District No. ea are regular and lawful, and that a'sewer to be laid in the district hereinafter defined is a public necessity, Now, therefore, be it ordained by the Mayor and City Council of the City of Grand Island, Nebraska: Section No.1. That Sewer District No. 633 of the City of Grand Island, Nebraska, is hereby created, same to consist of Block No. 48, Russel Wheeler's Addition to the City Of Grand Island. Said sewer is to be laid in the alley between Eleventh and Twelfth Streets, running through said block beginning at Eddy Street and running to Clark street in the mid City of Grand Island. Section No.2. Tha t a sewer shall be la id along the course above described, and running through said block, in accordance with the plans and specifications governing sewers heretofore established for laying sewers, insofar as said plans and specifications can be carried out. Section No.3. That the ent.ire cost of eonstrueting said sewer shall be assessed against the abutting property in said district, and a tax shall be levied as soon as the cost can be ascertained, said tax to become delinquent and draw interest as provided by law. Seotion No.4. ' The City Engineer is hereby authorized to draw plans and specifications for said sewer and make an estimate of the cost thereof and submit same to the City Council, and when adopted the City Clerk shall at once advertise for bids for the construction of said sewer, in aocordance with the plans and specifications submitted, reserving the right to reject any and all bids. - f ., 11 Section No.5. The tax so levied shall become payable, delinquent and draw interest as by law provided,namely:one tenth shall become delinquent in fifty days from date of this levy;one tenth in one year;one tenth in two years;one tenth in three years; one tenth in four years;one tenth in five years;one tenth in six years;one tenth in seven years;one tenth in eight years, and one tenth in nine years from date of this levy.Each of said install- ments save the first one, shall draw interest from date of this levy at the rate of 7 per centum per annum until the same becomes delinquent,and each of the delinquent installments shall draw interest at the rate of 10 per centum per annum from and after the date such installment becomes delinquent until paid. Provided,however,that the entire amount so levied and assessed against any of the aforesaid lots may be paid at any time within fifty days from date of such levy,without interest, and such lot,iD that event,shall be exempt from any lien or charge for such interest. Section No.3. The City Clerk of the City of Grand Island, Nebraska, is hereby directed to forthwith certify this ordinance to the City Treasurer of Grand Island, ~!ebraska, who shall proceed to collect said taxes as required by law. section No.4.
