10/25/2005 Resolutions 2005-314 I I RES 0 L UTI 0 N 2005-314 WHEREAS, on July 12, 2005, by Resolution 2005-197, the City Council ofthe City of Grand Island approved a Cooperative Agreement with the Natural Resources Conservation Service (NRCS) of the United States Department of Agriculture to install emergency watershed protection measures to relieve hazards and damages created by the flooding that occurred in the area in May 2005; and WHEREAS, the cost estimate of the project at the time of the agreement was $115,380; and WHEREAS, the only bid received for the project was $141,551.58, such increase in cost being due to design changes and increased material costs; and WHEREAS, based on such increased construction costs, it is necessary to amend the Cooperative Agreement to adjust the amounts required to be paid by the parties to the agreement; and WHEREAS, the City's share ofthe construction costs remains at 25%, estimated to be $35,388; and WHEREAS, the City's cost can include in-kind services such as engineering which is estimated at $19,580; and WHEREAS, the proposed Amendment No. 1 has been reviewed and approved by the City Attorney's office. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that Amendment No.1 to the Cooperative Agreement between the City and the Natural Resources Conversation Service of the United States Department of Agriculture (NRCS) is hereby approved to adjust the construction costs and amounts required to be paid by each party. BE IT FURTHER RESOLVED, that the Mayor is hereby authorized and directed to execute such amendment on behalf of the City of Grand Island.
