RES 0 L UTI 0 N 2005-138
WHEREAS, a public utility easement is required by the City of Grand Island, from
Bradley R. Petersen and Amy S. Petersen, husband and wife, to install, upgrade, maintain, and repair
public utilities and appurtenances; and
WHEREAS, a public hearing was held on May 10, 2005, for the purpose of
discussing the proposed acquisition of an easement and right-of-way through a part of Lot Four (4)
Wilson's Subdivision in Hall County, Nebraska, the twenty (20.0) foot wide utility easement and
right-of-way being more particularly described as follows:
Commencing at the northwest corner of Lot Four (4) Wilson's Subdivision; thence
southerly along the westerly line of said Lot Four (4), a distance of nineteen and sixty
one hundredths (19.61) feet to the ACTUAL point of beginning; thence deflecting
left 87011'40" and running easterly along the northerly line of Grantor's property, a
distance of four hundred sixty one and ninety four hundredths (461.94) feet; thence
deflecting right 89049'31" and running southerly along the easterly line of Grantor's
property, a distance of twenty (20.0) feet; thence deflecting right 90010'29" and
running westerly parallel to the northerly line of Grantor's property, a distance of four
hundred sixty one and one hundredth (461.01) feet to the westerly line of said Lot
Four (4); thence deflecting right 92048'20" and running northerly along the westerly
line of said Lot Four (4), a distance oftwenty and two hundredths (20.02) feet to the
said point of beginning.
The above-described easement and right-of-way containing 0.212 acres, more or less,
as shown on the plat dated May 2, 2005, marked Exhibit "A" attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Bradley R. Petersen and Amy S. Petersen
husband and wife, on the above-described tract of land.
Adopted by the City Council of the City of Grand Island, Nebraska, May 10, 2005.
