WHEREAS, a hikelbike path easement is required by the City of Grand Island, from
The Museum Board of Hall County Nebraska, a Nebraska political subdivision, to install, upgrade,
maintain, and repair a hikelbike path along the west and north side ofthe Stuhr Museum property at
U.S. Highway 281 and U.S. Highway 34; and
WHEREAS, a public hearing was held on November 23, 2004, for the purpose of
discussing the proposed acquisition of an easement and right-of-way through a part of Lot One (1) of
Stuhr Museum Subdivision located in the Northwest Quarter (NWl/4) and the Southwest Quarter
(SWl/4) of Section 32, Township 11 North, Range 9 West ofthe 6th P.M., city of Grand Island, Hall
County, Nebraska, the easement and right-of-way being more particularly described as follows:
Commencing at the Northwest Quarter of said Section 32; thence on an assumed bearing of
N89057'39"E along the north line of said Section 32 a distance of 808.12 feet; thence
departing said north line SOoo02'21 "E a distance of82.97 feet to a point on the northright-of-
way (RO.W.) line of Highway 34, said point also being the Point of Beginning; thence
SO 1 023'1 O"E a distance of 20.00 feet; thence S88036'50"W a distance of 85.92 feet; thence
S87028'37"W a distance of559.23 feet; thence S65050'51 "W a distance of68.66 feet; thence
S 17055'32"W a distance of67.95 feet; thence S02011 '04"E a distance of1504.85 feet; thence
SI6003'19"W a distance of83.52 feet; thence SOl 029'10"E a distance of832.54 feet; thence
SOl 028'58"E a distance of 495.66 feet; thence S22024'14"E a distance of 11 0.33 feet; thence
S09039'23 "W a distance of74.52 feet; thence SOl 028'58"E a distance of1172.97 feet; thence
S31048'18"E a distance of 74.47 feet to a point on the south line of Lot 1 of said Stuhr
Museum Subdivision; thence N89059'34"W along said south line a distance of82.62 feet to a
point on the east RO.W. line of Highway 281, said point also being the southwest comer of
said Lot 1; thence NOl o28'58"W along and upon said east RO.W. line a distance of1906.92
feet; thence NOl 029'1 O"W a distance of926.20 feet; thence N88030'50"E a distance of25.00
feet; thence N02011'04 "W a distance of 1599.44 feet to the point of intersection of said east
Highway 281 RO.W. line and the south R.O.W. line of Highway 34; thence N8r28'37"E
along and upon the south RO.W. line a distance of 666.35 feet; thence N88036'50"E a
distance of 86.11 feet to the point of beginning. Said permanent trail easement contains
13 7,721 square feet or 3.17 acres more or less, as shown on the plat attached hereto as
Exhibit A-I and A-2, and incorporated herein by this reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from The Museum Board of Hall County Nebraska, a
Nebraska political subdivision, on the above-described tract of land.
