WHEREAS, a public utility easement is required by the City of Grand Island, from
the Hall County Livestock Improvement Association, a Nebraska non-profit corporation, to install,
upgrade, maintain, and repair public utilities and appurtenances; and
WHEREAS, a public hearing was held on November 9,2004, for the purpose of
discussing the proposed acquisition of an easement and right-of-way through a part ofthe Southwest
Quarter (SWl/4) and the Southeast Quarter (SEl/4) of Section Twenty Two (22), Township Eleven
(11) North, Range Nine (9) West of the 6th P.M., located in the city of Grand Island, Hall County,
Nebraska; the boundaries of the twenty (20.0) foot wide easement and right-of-way being more
particularly described as follows:
Referring to the southeast comer of the Southwest Quarter (SWl/4) of Section
Twenty Two (22), Township Eleven (11) North, Range Nine (9) West; thence
northerly along the easterly line of the Southwest Quarter (SWl/4) said Section
Twenty Two (22), Township Eleven (11) North, Range Nine (9) West, a distance of
thirty three (33.0) feet to a point on the northerly right-of-way line of Stolley Park
Road; thence westerly along the northerly right-of-way line of said Stolley Park
Road, a distance of two hundred (200.0) feet to the ACTUAL Point of Beginning;
thence northerly and parallel with the easterly line ofthe Southwest Quarter (SWl/4)
of said Section Twenty Two (22), Township Eleven (11) North, Range Nine (9) West
on an assumed bearing ofNOooOO'OO"E, a distance of nine hundred seven and eighty
two hundredths (907.82) feet; thence S89056'32"E, a distance of three hundred thirty
two (332.0) feet; thence NOooOO'OO"E, a distance of twenty (20.0) feet; thence

feet; thence N89033'52"W and parallel with the northerly right-of-way line of said
Stolley Park Road, a distance of seventy five (75.0) feet; thence SOooOO'OO"E, a
distance of twenty (20.0) feet to a point on the northerly right-of-way line of said
Stolley Park Road; thence S89033'52"E along the northerly right-of-way line of said
Stolley Park Road, a distance of ninety five (95.0) feet to the said Point of Beginning.
The above-described easement and right-of-way containing 1.76 acres, more or less,
as shown on the plat dated October 26,2004, marked Exhibit "A" attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Hall County Livestock Improvement
Association, a Nebraska non-profit corporation, on the above-described tract ofland.
