WHEREAS, a storm sewer easement is required by the City of Grand Island, from
John R. Menard, a single person, to install, upgrade, maintain, and repair public utilities and
appurtenances; and
WHEREAS, a public hearing was held on October 12, 2004, for the purpose of
discussing the proposed acquisition of a storm sewer easement through a part of Lot Five (5),
Menard Second Subdivision, located in the Northeast Quarter (NE1I4) of Section 12, Township 11
North, Range 10 West of the 6th P.M. in the city of Grand Island, Hall County, Nebraska, the
easement being more particularly described as follows:
Commencing at the southwest comer of said Lot 5, said point also being on the north
right-of-way (ROW) line of Carlton Avenue; thence S89000'58"Ealongthe south line
of said Lot 5 a distance of 45.43 feet to the point of intersection of said south line and
the east line of an existing 16 foot utility easement, said point also being the Point of
Beginning; thence NOooI6'39"E along said east line a distance of225.19 feet to the
point of intersection of said east line and the south line of an existing 16 foot utility
easement; thence S890Ol'04"E along said south line a distance of 1 0.00 feet; thence
SOooI6'39"W a distance of 225.19 feet to a point on the south line of said Lot 5;
thence N89000'58"W along said south line a distance of 10.00 feet to the point of
beginning.
The above-described storm sewer easement contains 2251.88 square feet or 0.052
acres, more or less, as shown on Exhibit "A" attached hereto and incorporated herein
by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a storm sewer easement from John R. Menard, a single person, on the above-
described tract of land.

A STORM SEWER EASEMENT CONSISTING OF PART OF LOT 5 OF MENARD SECOND SUBDIVISION, LOCATED IN THE NORTHEAST
QUATER (NE1/4) OF SECTION 12, TOWNSHIP 11 NORTH, RANGE 10 WEST OF THE 6TH P.M., CITY OF GRAND ISLAND, HALL
COUNTY, NEBRASKA AND MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHWEST CORNER OF SAID LOT 5, SAID POINT ALSO BEING ON THE NORTH RIGHT-OF-WAY (R.O.W.)
