07/27/2004 Resolutions 2004-176 I I I RES 0 L UTI 0 N 2004-176 WHEREAS, real property is required by the City of Grand Island for additional right- of-way along 13th Street west of the Highland Park Drainway to complete the construction for Sanitary Sewer District 510 (American Independence Subdivision) and Sanitary Sewer District 514 (Bockman Subdivision); and WHEREAS, a public hearing was held on July 27,2004, for the purpose of discussing the acquisition of rights-of-way affecting the following tracts ofland: Owner(s) Imogene & Teddy Lechner, husband and wife Jacqueline Hanover and Imogene Lechner as Co- Trustees of the Irene A. Neumann Revocable Living Trust Property Description Seventeen (17.0) feet of additional right-of-way in the West Half ofthe Northwest Quarter ofthe Northwest Quarter (Wl/2, NWl/4, NWl/4) of Section Fourteen (14), Township Eleven (11) North, Range Ten (10) West of the 6th P.M. in Hall County, Nebraska, more particularly described as follows: Beginning at the southwest comer of Western Heights Fourth Subdivision; thence west on the north line of Section 14-11-10 to the northwest cornerofthe NWl/4, NWl/4, of Section 14- 11-10; thence south along the west line of the NWl/4, NWl/4, of Section 14-11-10, a distance of Fifty (50.0) feet; thence east on a line Fifty (50.0) feet south of and parallel to the north line of Section 14-11- 10, a distance of One Thousand Three Hundred Fourteen and Sixty Six Hundredths (1,314.66) feet more or less; thence north a distance of Fifty (50.0) feet to the point of beginning. This right-of-way includes the north Thirty Three (33.0) feet and west Thirty Three (33.0) feet of this tract which is already 13th Street right- of-way and Engleman Road right-of-way; the remaining south Seventeen (17.0) feet contains .50 acres more or less, and is shown on the plat dated April 6, 2004, marked Exhibit "A" attached hereto and incorporated herein by reference. Seventeen (17.0) feet of additional right-of-way in the East Half ofthe Northwest Quarter ofthe Northwest Quarter (E1/2, NWl/4, NW1/4) of Section Fourteen (14), Township Eleven (11) North, Range Ten (10) West of the 6th P.M. in Hall County, Nebraska, more particularly described as follows: Beginning at a point being the southeast comer of American Independence Subdivision; thence west on the north line of Section 14-11-10 a distance of One Thousand Two Hundred Seventy Four and Sixty Five Hundredths (1,274.65) feet more or less; thence south on a line parallel to the west line of Section 14-11-10 a distance of Fifty (50.0) feet; thence east on a line Fifty (50.0) feet south of and parallel to the north line of Section 14-11-10, a distance of One Thousand Two Hundred Seventy Four and Sixty Five Hundredths Approved as to Form Xl July 23, 2004 Xl City Attorney I I I (1,274.65) feet more or less, to a point Forty (40.0) feet west of the east line of the NW1I4, NW1I4 of Section 14-11-10; thence north Fifty (50.0) feet to the point of beginning. This right-of-way includes the north Thirty Three (33.0) feet of this tract which is already 13th Street right-of-way, the remaining south Seventeen (17.0) feet contains .50 acres more or less, and is shown on the plat April 6, 2004, marked Exhibit "B" attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire right-of-way from the parties identified above on the above-described tracts of land.
