05/25/2004 Resolutions 2004-118 I I I RES 0 L UTI 0 N 2004-118 WHEREAS, public utility easements are required by the City of Grand Island, from Lacy Construction Company, f/k/a Lacy Building and Supply Company, Inc., a Nebraska corporation, to install, upgrade, maintain, and repair public utilities and appurtenances; and WHEREAS, a public hearing was held on May 25, 2004, for the purpose of discussing the proposed acquisition of easements and rights-of-way through a part of Lot One (1) and Lot Three (3), Lacy Subdivision in the City of Grand Island, Hall County, Nebraska, the utility easements and rights-of-way being more particularly described as follows: Tract No.1: The northerly twenty (20.0) feet of the westerly ten (10.0) feet of Lot One (1) Lacy Subdivision. The above-described easement and right-of-way contains a total of200 square feet, more or less, as shown on the plat dated May 3,2004, marked Exhibit "A", attached hereto and incorporated herein by reference. Tract No.2: The northerly twenty (20.0) feet ofthe easterly ten (10.0) feet of Lot Three (3) Lacy Subdivision. The above-described easement and right-of-way contains a total of200 square feet more or less, as shown on the plat dated May 3,2004, marked Exhibit "B", attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire public utility easements from Lacy Construction Company, f/kIa Lacy Building and Supply Company, Inc., a Nebraska corporation, on the above-described tracts of land.
