03/23/2004 Resolutions 2004-61 I I I RES 0 L UTI 0 N 2004-61 WHEREAS, a permanent drainage easement is required by the City of Grand Island, from Michael D. Roush, a single person, Marlene C. Roush, a widow, and Dana Jelinek and Ronald Jelinek, wife and husband, as co-owners, to install, upgrade, maintain, and repair drainage structures and appurtenances; and WHEREAS, a public hearing was held on March 23, 2004, for the purpose of discussing the proposed acquisition of an easement through a part of Lot One (1), Firethom Estates Second Subdivision in the City of Grand Island, located in the Southwest Quarter (SWl/4) of Section Twenty Seven (27), Township Eleven (11) North, Range Nine (9) West of the 6th P.M. in Hall County, Nebraska, the easement and right-of-way being more particularly described as follows: Commencing at the northwest comer of said Lot 1; thence on an assumed bearing of SOl 011'57"E along the west line of said Lot 1 a distance of 179.60 feet said point also being the point of beginning; thence S89054'27"E a distance of 15.00 feet; thence SO 1 012' 13 "E parallel with said west line of Lot 1, said line also being the east right-of- way (R.O.W.) line of Midaro Drive a distance of 651.30 feet; thence S89054'27"E parallel with the south line of said Lot 1; said line also being the north R.O.W. line of Midaro Drive a distance of 421.95 feet to a point on the east line of said Lot 1; thence SO 1 015'33 "E along said east line a distance of 1 0.00 feet to a point on the south line of said Lot 1; thence N89054'27"W along said south line a distance of 436.96 feet to a point on said west line of said Lot 1; thence NO 1 012' 13 "W along said west line a distance of 661.30 feet to the point of beginning. Said tract contains a calculated area of 14,141.58 square feet or 0.3246 acres more or less. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a permanent drainage easement from Michael D. Roush, a single person, Marlene C. Roush, a widow, and Dana Jelinek and Ronald Jelinek, wife and husband, as co-owners, on the above-described tract of land.
