01/13/2004 Resolutions 2004-2 I I I RES 0 L UTI 0 N 2004-2 WHEREAS, a public utility easement is required by the City of Grand Island, from Good Hitters, Inc., a corporation, to install, upgrade, maintain, and repair public utilities and appurtenances; and WHEREAS, a public hearing was held on January 13, 2004, for the purpose of discussing the proposed acquisition of an easement and right-of-way through a part ofthe Northwest Quarter of Section Twelve (12), Township Eleven (11) North, Range Ten (10) West ofthe 6th P.M. in the city of Grand Island, Hall County, Nebraska, the easement and right-of-way being more particularly described as follows: Tract No.1: A five (5.0) foot wide tract of land; the southerly line being more particularly described as follows: Commencing at a point on the west line of the Northwest Quarter (NW1I4) of Section Twelve (12), Township Eleven (11) North, Range Ten (10) West, being three hundred ninety (390.0) feet north of the southwest comer of the Northwest Quarter (NW1/4) of said Section Twelve (12), Township Eleven (11) North, Range Ten (10) West; thence easterly and parallel with the south line of the Northwest Quarter (NW1I4) of said Section Twelve (12), Township Eleven (11) North, Range Ten (10) West, a distance of thirty three (33.0) feet to a point on the easterly line of North Road being the ACTUAL point of beginning; thence continuing easterly along the previously described line, a distance of twenty five (25.0) feet. Tract No.2: A twenty (20.0) foot wide tract of land; the northerly line being more particularly described as follows: Commencing at a point on the west line of the Northwest Quarter (NW1I4) of Section Twelve (12), Township Eleven (11) North, Range Ten (10) West, being five hundred thirty five (535.0) feet north ofthe southwest comer of the Northwest Quarter (NW1I4) of said Section Twelve (12), Township Eleven (11) North, Range Ten (10) West; thence easterly and parallel with the south line of the Northwest Quarter (NW1I4) of said Section Twelve (12), Township Eleven (11) North, Range Ten (10) West, a distance of thirty three (33.0) feet to a point on the easterly line of North Road being the ACTUAL point of beginning; thence continuing easterly along the previously described line, a distance of two hundred (200.0) feet. Tract No.3: A ten (10.0) foot wide tract of land; the northerly line being more particularly described as follow: Commencing at a point on the west line of the Northwest Quarter (NW1/4) of Section Twelve (12), Township Eleven (11) North, Range Ten (1 0) West, being five hundred thirty five (535.0) feet north ofthe southwest comer of the Northwest Quarter (NW1I4) of said Section Twelve (12), Township Eleven (11) North, Range Ten (10) West; thence easterly and parallel with the south line of the Approved as to Form a January 8, 2004 a City Attorney I I I Northwest Quarter (NW1/4) of said Section Twelve (12), Township Eleven (11) North, Range Ten (10) West, a distance oftwo hundred thirty three (233.0) feet to the ACTUAL point of beginning; thence continuing easterly along the previously described line, a distance of sixty seven (67.0) feet. The above-described easement and right-of-way containing a combined total of 0.11 acres, more or less, as shown on the plat dated December 27,2003, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Good Hitters, Inc., a corporation, on the above- described tract of land.
