WHEREAS, a sidewalk easement is required by the City of Grand Island, from Grand
Island Retirement L.L.c., a limited liability company, to install, upgrade, maintain, and repair
sidewalks; and
WHEREAS, a public hearing was held on December 23, 2003, for the purpose of
discussing the proposed acquisition of an easement and right-of-way through a part of Lot One (1)
Primrose Subdivision in the city of Grand Island, Hall County, Nebraska, the easement and right-of-
way being more particularly described as follows:
Beginning at the southwest comer of Lot One (1) Primrose Subdivision; thence north
on the west line of Lot One (1) Primrose Subdivision for a distance of Thirty Five
and Five Tenths (35.5) feet; thence southeasterly on a line to a point Ten (10.0) feet
north of and Twenty Five (25.0) feet east of the southwest comer of Lot One (1)
Primrose Subdivision; thence east on a line Ten (10.0) feet north of and parallel to
the south line of said Lot One (1) Primrose Subdivision to the east line of said Lot
One (1) Primrose Subdivision; thence south on the east line of Lot One (1) Primrose
Subdivision to the southeast comer of Lot One (1) Primrose Subdivision; thence
west on the south line of Lot One (1) Primrose Subdivision to the point of beginning,
as shown on the plat dated December 15, 2003, marked Exhibit "A" attached hereto
and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a sidewalk easement from Grand Island Retirement L.L.C., a limited liability
company, on the above-described tract of land.
Adopted by the City Council of the City of Grand Island, Nebraska, December 23,2003.
