12/15/2009 Resolutions 2009-326RESOLUTION 2009-326 WHEREAS, an application was filed by Club 69, Inc., doing business as Club 69,106 East 3`d Street for a Class "C" Liquor License; and WHEREAS, a public hearing notice was published in the Grand Island Independent as required by state law on December 5, 2009; such publication cost being $14.73; and WHEREAS, a public hearing was held on December 15, 2009 for the purpose of discussing such liquor license application. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that: The City of Grand Island hereby recommends approval ofthe above-identified liquor license application contingent upon final inspections. The City of Grand Island hereby makes no recommendation as to the above- identified liquor license application. The City of Grand Island hereby makes no recommendation as to the above- identified liquor license application with the following stipulations: The City of Grand Island hereby recommends denial of the above-identified liquor license application for the following reasons: See attached. The City of Grand Island hereby recommends approval ofNickie Kallos,1704 East 7t'' Street for liquor manager of such business upon the completion of a state approved alcohol server/seller training program. Adopted by the City Council of the City of Grand Island, Nebraska, December 15, 2009. ~~ -zr -~ Margare ornady, Mayor Attest: RaNae Edwards, City Clerk Approved as to Form p December 14, 2009 p City Attorney • The owner, Mr. Kallos has not demonstrated the type of management and control in owning the licensed premise to be sufficient to insure that the licensed business conforms to the provisions and requirements of the license. • There are multiple on sale liquor establishments in Grand Island of which none demand the level of law enforcement services that Club 69 requires. Club 69 requires the use of additional law enforcement resources because of high calls for service and crimes generated from the liquor license. • The Club 69 liquor license is not consistent with the public interest.
