12/15/2009 Resolutions 2009-315RESOLUTION 2009-315 WHEREAS, a public utility easement is required by the City of Grand Island, from Nebraska Investment Association, LLC, to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including lines and transformers; and; WHEREAS, a public hearing was held on December 15, 2009, for the purpose of discussing the proposed acquisition of an easement located in Hall County, Nebraska; and more particularly described as follows: Commencing at the southwest corner of Lot Two (2) Meadowlark West Seventh Subdivision in the City of Grand Island, Hall County, Nebraska; thence northerly along the westerly line of said Lot Two (2), a distance of eighteen (18.0) feet to the ACTUAL Point of Beginning; thence continuing northerly along the westerly line of said Lot Two (2), a distance of twenty (20.0) feet; thence easterly parallel with the southerly line of said Lot Two (2), a distance of forty five (45.0) feet; thence southerly parallel with the westerly line of said Lot Two (2), a distance of twenty (20.0) feet; thence westerly parallel with the southerly line of said Lot Two (2), a distance of forty five (45.0) feet to a point on the westerly line of said Lot Two (2) being the said Point of Beginning. The above-described easement and right-of--way containing 900 square feet, more or less, as shown on the plat dated 11/3/2009, marked Exhibit "A", attached hereto and incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Nebraska Investment Association, LLC, on the above-described tract of land.
