04/08/2003 Resolutions 2003-93 I I I RES 0 L UTI 0 N 2003-93 WHEREAS, utility easements are required by the City of Grand Island, from the owners of real property along South Locust Street between Stolley Park Road and Fonner Park Road to install, upgrade, maintain, and repair power appurtenances, including lines and transformers; and WHEREAS, a public hearing was held on April 8, 2003, for the purpose of discussing the proposed utility easements; and WHEREAS, in the event the City and the various owners are unable to agree upon a price for such utility easement, it is suggested that the City be authorized to condemn such property for public facilities in accordance with Neb. Rev. Stat. 19-709, as amended. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire utility easements from the parties and property described as Tracts No.1, 2, 3, 4,5,6,7,8,9,10,11,13,14,15,17, 18, 19,21,23,24,26,27,28,29, and 30 as attached hereto as Exhibit "A". BE IT FURTHER RESOLVED, that ifthe acquisition of such property is not possible through negotiations, the City Attorney is hereby authorized and directed to commence condemnation proceedings on behalf ofthe City of Grand Island to acquire such property forthwith.
