WHEREAS, the City is interested in acquiring property from the School District of
Grand Island, for the purpose of public right-of-way along the south side of Westridge Middle
School to connect the Shoemaker hike/bike trail to the east of West ridge Middle School on Manfield
Road that will be built along Independence Avenue; and
WHEREAS, a public hearing was held on October 22, 2002 for the purpose of
discussing the proposed acquisition of an easement being more particularly described as follows:
The North Twenty (20.0) feet of the south Forty (40.0) feet of Lots Nine (9) and
Ten(10), Sussex Place Subdivision, City of Grand Island, Hall County, Nebraska;
said easement contains 12,609 square feet or 0.29 acres more or less of which 12,609
square feet or 0.29 acres is existing dedicated easement, as shown on the attached
drawing dated October 2002 attached hereto and incorporated herein by reference.
WHEREAS, Section 19-709, R.R.S. 1943, authorizes the City to appropriate private
property for use of the City for public facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island is hereby authorized
to acquire an easement from the School District of Grand Island, for the above-described property.
Adopted by the City Council of the City of Grand Island, Nebraska on October 22,2002.
