09/24/2002 Resolutions 2002-290 I I I RES 0 L UTI 0 N 2002-290 WHEREAS, a public utility easement is required by the City of Grand Island, from Shafer Properties, for the purpose of realigning the sanitary sewer service lines due to a change in the construction plans for development in the area; and WHEREAS, a public hearing was held on September 24, 2002, for the purpose of discussing the proposed acquisition of an easement and right-of-way through a part of Lot Three (3) Crane Valley Fourth Subdivision in the City of Grand Island, Hall County, Nebraska, the easement and right-of-way being more particularly described as follows: Commencing at the northeast comer of Lot 1 of said Subdivision, said point also being the point of beginning; thence N90000'00''W along and upon the north line of said Lot 1 a distance of7 .98 feet to the point of intersection of said north line and the east line of an existing Utility Easement; thence NOoo26' 41 "w along and upon said easement line which is 1 0 feet east of and parallel to the west property line of Lot 3 of said Subdivision a distance of149.65 feet; thenceN89033'09"Ealong and upon an existing easement line which is 1 0 feet south of and parallel to the north line of said Lot 3 a distance of 13.35 feet; thence departing said easement line SOoo26'41"E a distance of 165.10 feet to a point on the east line of Lot 1 of said subdivision; thence N19041 '09"W along and upon said east line a distance of 16.29 feet to the point of beginning. The above-described easement and right-of-way containing a total of2039. 72 square feet, more or less as shown on the plat marked Exhibit "A" attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Shafer Properties, on the above-described tract ofland.
