09/24/2002 Resolutions 2002-289 I I I RES 0 L UTI 0 N 2002-289 WHEREAS, a public utility easement is required by the City of Grand Island, from Concord Development, L.L.C., a limited liability company, for the purpose of realigning the sanitary sewer service lines due to a change in the construction plans for development in the area; and WHEREAS, a public hearing was held on September 24, 2002, for the purpose of discussing the proposed acquisition of an easement and right-of-way through a part of Lot One (1) Crane Valley Fourth Subdivision in the City of Grand Island, Hall County, Nebraska, the easement and right-of-way being more particularly described as follows: Commencing at the south comer of said Lot 1, said point also being the point of intersection ofthe northwesterly R.O.W. line of Diers Avenue and the northeasterly RO.W.line of Concord Avenue, said point also being the point of beginning; thence along and upon said northeasterly RO.W. line around a curve in a counter clockwise direction having a delta angle of 03029'56", an arc length of20.15 feet, a radius of 330.00 feet and chord bearing N52004'03"W for a distance of 20.15 feet; thence departing said northeasterly RO.W. line N44053'53"E a distance of 145.02 feet: thence NO 1 048' 3 8"W a distance of 85.28 feet to a point on the north line of said Lot 1; thence N90000' OO"E along and upon said north line a distance of 15.01 feet to the northeast comer of said Lot 1; thence S 19041 '09"E along and upon the east property line of said Lot 1 a distance of 16.29 feet; thence departing said east line SOl 048'38"E a distance of88.42 feet to a point on the northwesterly R.O.W.line of Diers Avenue; thence along and upon said RO.W. line around a curve in a counter clockwise direction having a delta angle of 16044'38", an arc length of 52.60 feet, a radius of 180.00 feet and a chord bearing of S53016'1l "W for a distance of 52.42 feet; thence S44053'53"W a distance of92.17 feet to the point of beginning. The above-described easement and right-of-way containing a total of 4865. 76 square feet, more or less as shown on the plat marked Exhibit "A" attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Concord Development, L.L.C., a limited liability company, on the above-described tract of land.
