WHEREAS, a public utility easement is required by the City of Grand Island, from
PEDCOR Investments, L.L.c., a limited liability company, to relocate an existing sewer line; and
WHEREAS, a public hearing was held on August 13, 2002, for the purpose of
discussing the proposed acquisition of an easement and right-of-way through a part of Lot Three (3),
Pedcor Subdivision an addition to the City of Grand Island, Hall County, Nebraska, the easement
and right-of-way being more particularly described as follows:
Referring to the Southwest comer of said Lot 3; thence Easterly on the South line of
said Lot 3 a distance of 40.0 feet to a point on the East line of a Utility Easement;
thence Northerly on the East line of said Utility Easement a distance of 144.32 feet
to the ACTUAL PLACE OF BEGINNING; thence with a deflection angle to the
right of 9045' in a northeasterly direction on said East line a distance of 123.96 feet;
thence left 9045' in a northerly direction a distance of 333.38 feet; thence left 8039'
in a northwesterly direction a distance of205.96 feet; thence leaving said east line of
said utility easement right 177016' in a southeasterly direction a distance of207.70
feet; thence right 11023' in a southerly direction a distance of 333.38 feet; thence
right 14014' in a southwesterly direction a distance of 126.04 feet to the place of
beginning.
The above-described easement and right-of-way containing 4972 square feet, more
or less as shown on the plat dated July 31,2002, marked Exhibit "A" attached hereto
and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from PEDCOR Investments, L.L.C., a limited liability
company, on the above-described tract of land.
Adopted by the City Council of the City of Grand Island, Nebraska, August 13,2002.
