05/21/2002 Resolutions 2002-132 I I I RES 0 L UTI 0 N 2002-132 WHEREAS, a public utility easement is required by the City of Grand Island, from Kramer's Auto Parts and Iron Company, Inc., a Nebraska corporation, to install, upgrade, maintain, and repair power appurtenances, including lines and transformers; and WHEREAS, a public hearing was held on May 21, 2002, for the purpose of discussing the proposed acquisition of an easement and right-of-way through a part ofthe Southwest Quarter (SW1I4) of Section Thirty Three (33), Township Twelve (12) North, Range Nine (9) West of the 6th P.M. in Hall County, Nebraska, the centerline of the twenty (20.0) foot wide utility easement and right-of-way being more particularly described as follows: Tract No.1: Beginning at a point on the northerly line of Lot one (1) Kramers Subdivision, Hall County, Nebraska, being one hundred sixty five and five tenths (165.5) feet easterly of the northwest comer; thence northerly parallel to the westerly line of the Southwest Quarter (SWII4) of Section Thirty Three (33), Township Twelve (12) North, Range Nine (9) West ofthe 6th P.M., a distance of five hundred sixty one and five tenths (561.5) feet to a point on the northerly line ofthe tract ofland as described in Document 94-108632, recorded at the Register of Deeds Office, Hall County, Nebraska. AND Tract No.2: Commencing at a point on the westerly line of the Southwest Quarter (SW1I4) of Section Thirty Three (33), Township Twelve (12) North, Range Nine (9) West ofthe 6th P.M., being one thousand three hundred fifty and eight tenths (1,350.8) feet north of the southwest comer of the said Southwest Quarter (SWl/4); thence easterly perpendicular to the westerly line of said Southwest Quarter (SW1I4), a distance of two hundred thirty one and five tenths (231.5) feet to the Actual Point of Beginning; thence continuing easterly on the last described course, a distance of twenty four (24.0) feet; thence northerly parallel to the westerly line of said Southwest Quarter (SWl/4), a distance of thirty (30.0) feet. The above-described easement and right-of-way containing a combined total of 0.278 acres acres, more or less as shown on the plat dated May 1, 2002, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Kramer's Auto Parts and Iron Company, Inc., a Nebraska corporation, on the above-described tract of land.
