RESOLUTION 2002-128
WHEREAS, on April 10, 2001, by Resolution 2001-89, the City of Grand Island
approved an agreement the Nebraska Department of Roads for the improvement of US. Highway 30
in Grand Island from just east ofthe Burlington Northern Sante Fe Railroad viaduct to just west of
the Warm Slough by building a five-lane urban highway including grading, storm sewer, concrete
pavement, relocation of Stuhr Road intersection, traffic signals and roadway lighting; and
WHEREAS, during the initial phases ofthe work, the Nebraska Department of Roads
found asbestos material and other miscellaneous construction debris where the new connection
between U.S. Highway 30 and Seedling Mile Road is to be built; and
WHEREAS, the asbestos material and debris will need to be excavated and
transported to an approved dumping area; and
WHEREAS, Supplemental Agreement No.1 sets out the terms and conditions for the
removal of such asbestos material and debris; and
WHEREAS, the City will agree to release up to $1,035,552 of its unobligated federal
Surface Transportation Program (STP) funds for its 20% share of the total project cost.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that Supplemental Agreement No.1 between the
City and the Nebraska Department of Roads is hereby approved to provide the terms and conditions
for the removal of asbestos materials and other miscellaneous construction debris for the
improvement project at the intersection of US. Highway 30 and Stuhr Road/Seedling Mile Road.
BE IT FURTHER RESOLVED, that the Mayor is hereby authorized and directed to
execute such agreement on behalf of the City of Grand Island.
