02/12/2002 Resolutions 2002-43 I I I RES 0 L UTI 0 N 2002-43 WHEREAS, a public utility easement is required by the City of Grand Island, from Margaret A. Meyer n/k/a Margaret A. Nienhueser and Kenneth Nienhueser, wife and husband, to install, upgrade, maintain, and repair power appurtenances, including lines and transformers; and WHEREAS, a public hearing was held on February 12, 2002, for the purpose of discussing the proposed acquisition of an easement and right-of-way through a part of the Northwest Quarter (NWl/4) of Section Fourteen (14), Township Eleven (11) North, Range Nine (9) West ofthe 6th P.M. in the city of Grand Island, Hall County, Nebraska, the easement and right-of-way being more particularly described as follows: Commencing at the northwest comer ofthe Northwest Quarter (NWl/4) of Section Fourteen (14), Township Eleven (11) North, Range Nine (9) West of the 6th P.M.; thence southerly along the westerly line of said Northwest Quarter (NWl/4), a distance of One Thousand Fifty Five and Twelve Hundredths (1,055.12) feet; thence easterly deflecting left 92057'42", a distance of Thirty Three and Five Hundredths (33.05) feet to a point on the easterly right-of-way line of Stuhr Road, being the actual Point of Beginning; thence continuing easterly and deflecting 000'0", a distance of Twenty Seven and Seventy Hundredths (27.70) feet; thence southerly deflecting right 87039'54", a distance of One Hundred Fifty Five and Thirty One Hundredths (155.31) feet; thence southerly deflecting right 13008'14", a distance of Three Hundred Seven and Eighty Eight Hundredths (307.88) feet to a point on the easterly right-of-way line of said Stuhr Road; thence northerly deflecting right 172009'34" and along the easterly right-of-way line of said Stuhr Road, a distance of Four Hundred Fifty Eight and Twenty Two Hundredths (458.22) feet to the Point of Beginning. The above-described easement and right-of-way containing a total of 0.270 acres, more or less as shown on the plat dated January 21, 2002, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Margaret A. Meyer n/k/a Margaret A. Nienhueser and Kenneth Nienhueser, wife and husband, on the above-described tract of land. Adopted by the City Council ofthe City of Grand Island, Nebraska, December 18,2001.
