WHEREAS, a public utility easement is required by the City of Grand Island, from
MJ. Lake, L.L.C., a Nebraska limited liability company, to install, upgrade, maintain, and repair
power appurtenances, including lines and transformers; and
WHEREAS, a public hearing was held on October 23, 2001, for the purpose of
discussing the proposed acquisition of an easement and right-of-way through a part ofthe Northeast
Quarter (NE 1/4) of Section Fifteen (15), Township Eleven (11) North, Range Nine (9) West ofthe
6th P.M. in city of Grand Island, Hall County, Nebraska, the easement and right-of-way being more
particularly described as follows:
Commencing at the Northeast comer of the Northeast Quarter (NEl/4) of Section
Fifteen (15), Township Eleven (11) North, Range Nine (9) West of the 6th P.M.;
thence southerly along the easterly line of said Northeast Quarter (NE1/4), a distance
of one thousand three hundred seventy five (1,375.0) feet; thence westerly deflecting
right 90000'00", a distance of thirty three (33.0) feet to a point on the westerly right-
of-way line of said Stuhr Road, being the actual Point of Beginning; thence
northwesterly deflecting right 82032'58", a distance of one hundred twenty six and
fifty nine hundredths (126.59) feet; thence northeasterly deflecting right 59041 '17",
a distance of twenty and seventy six hundredths (20.76) feetto a point on the westerly
right-of-way line of said Stuhr Road, being one thousand two hundred thirty six and
fifty three hundredths (1,236.53) feet south of the Northeast Quarter (NEl/4); thence
southerly along the westerly right-of-way line of said Stuhr Road, a distance of one
hundred thirty eighty and forty seven hundredths (138.47) feet to the Point of
Beginning.
The above-described easement and right-of-way containing a total of 0.026 acres,
more or less as shown on the plat dated October 2, 2001, marked Exhibit "A"
attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from MJ. Lake, L.L.C., a Nebraska limited liability
company, on the above-described tract of land.
