10/23/2001 Resolutions 2001-289 I I I RESOLUTION 2001-289 WHEREAS, a public utility easement is required by the City of Grand Island, from Melvin W. Meyer and Joann Meyer, husband and wife, to install, upgrade, maintain, and repair power appurtenances, including lines and transformers; and WHEREAS, a public hearing was held on October 23, 2001, for the purpose of discussing the proposed acquisition of an easement and right-of-way through a part ofthe Northeast Quarter (NEl/4) of Section Fifteen (15), Township Eleven (11) North, Range Nine (9) West of the 6th P.M. in city of Grand Island, Hall County, Nebraska, the easement and right-of-way being more particularly described as follows: Commencing at the Northeast comer of the Northeast Quarter (NEl/4) Section Fifteen (15), Township Eleven (11) North, Range Nine (9) West of the 6th P.M.; thence southerly along the easterly line of said Northeast Quarter (NEl/4), a distance of one thousand two hundred thirty six and fifty three hundredths (1,236.53) feet; thence westerly deflecting right 90000'00", a distance ofthirty three (33.0) feet to a point on the westerly right-of-way line of said Stuhr Road, being the actual Point of Beginning; thence southwesterly deflecting right 52014'15", a distance of twenty and seventy six hundredths (20.76) feet; thence northwesterly deflecting right 120018'43", a distance of sixteen and sixty two hundredths (16.62) feet; thence northerly parallel with the westerly right-of-way line of said Stuhr Road, a distance of one hundred seventy nine and thirty two hundredths (179.32) feet to a point on the right-of-way line of said Stuhr Road; thence easterly along the right-of-way line of said Stuhr Road, a distance of eighteen and fifty seven hundredths (18.57) feet to a point thirty three (33.0) feet west of the easterly line of the said Northeast Quarter (NE 1/4); thence southerly along the westerly right-of-way line of said Stuhr Road, a distance of one hundred eighty two and eighty five hundredths (182.85) feet to the Point of Beginning. The above-described easement and right-of-way containing a total of 0.081 acres, more or less as shown on the plat dated October 2, 2001, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Melvin W. Meyer and Joann Meyer, husband and wife, on the above-described tract of land. Adopted by the City Council of the City of Grand Island, Nebraska, October 23,2001.
