10/09/2001 Resolutions 2001-284 I I I RESOLUTION 2001-284 WHEREAS, on February 19,1973, the City of Grand Island approved the final plat and Subdivision Agreement for Fonner Second Subdivision; and WHEREAS, because Lot Two (2) of such subdivision did not abut upon a public street, the Subdivision Agreement prohibited the conveyance of such lot by the developer until certain criteria were met providing ingress and egress from a dedicated, public street; and WHEREAS, ingress and egress to Lot Two (2), Fonner Second Subdivision is now available using Santa Anita Drive; and WHEREAS, the restriction prohibiting the conveyance of Lot Two (2), Fonner Second Subdivision is no longer necessary in the Fonner Second Subdivision Agreement; and WHEREAS, it is recommended that the Fonner Second Subdivision Agreement be amended to remove such restriction on Lot Two of such subdivision; and WHEREAS, an Amended Subdivision Agreement for Fonner Second Subdivision has been reviewed and approve by the City Attorney's office. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the Amended Subdivision Agreement for Fonner Second Subdivision removing the restriction prohibiting the conveyance of Lot Two (2) of such subdivision is hereby approved; and the Mayor is hereby authorized and directed to execute such Amended Subdivision Agreement on behalf of the City of Grand Island.
