WHEREAS, on July 10, 2001, by Resolution 2001-184 the Mayor and City Council
approved the Agreement for Sale and Purchase of Real Estate by and between the City of Grand
Island and the Civic Redevelopment Group, L.L.c., a Nebraska limited liability company to purchase
the former City Hall and authorized the Mayor to execute such agreement; and
WHEREAS, on July 10, 2001, by Ordinance No. 8683, the City of Grand Island
authorized the conveyance of the former City Hall property located at 102 West Second Street,
Grand Island, Hall County, Nebraska to Civic Redevelopment Group, L.L.C., a Nebraska limited
liability company; and
WHEREAS, if a remonstrance against such conveyance signed by registered voters
of the City of Grand Island equal in number to thirty percent of the registered voters of the City of
Grand Island voting at the last regular municipal election held in the city is filed with the City
Council within thirty days of passage and publication of such ordinance, said property shall not then,
nor within one year thereafter, be sold; and
WHEREAS, the last regular municipal election in the City of Grand Island was held
on November 7, 2000, with 12,712 registered voters voting at such election, 30% of which number
is 3,814 registered voters; and
WHEREAS, on August 13, 2001, within thirty days from the publication of the
ordinance authorizing the conveyance, said remonstrance bearing 4,508 signatures was filed with
the City Clerk for signature verification; and
WHEREAS, on August 30, 2001, the remonstrance was delivered to the Hall County
Election Commissioner to determine the validity and sufficiency of signatures on the remonstrance;
and
WHEREAS, on September 20, 2001, the Hall County Election Commissioner
certified to the Mayor and City Council that in accordance with 916-202, a valid remonstrance
requires 3,814 valid signatures; and
WHEREAS, on September 20, 2001, the Hall County Election Commissioner
certified to the Mayor and City Council in accordance with 916-202, the name and address of each
signor found not to be a registered voter of the City of Grand Island, the signature page number and
line number where the name is found, and the reason for the invalidity ofthe signature or address;
and
WHEREAS, on September 25, 2001, a public hearing was held to review the
remonstrance and certifications from the Hall County Election Commissioner, and to receive
testimony regarding them; and

WHEREAS, following the hearing, the Mayor and City Council determined that the
remonstrance is valid, sufficient valid signatures have been received, and the remonstrance shall be
upheld.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that Resolution 2001-184 should be and hereby
is repealed.
BE IT FURTHER RESOLVED, that the Agreement for Sale and Purchase of Real
Estate by and between the City and Civic Redevelopment Group, L.L.c., a Nebraska limited liability
company, shall be declared void and of no further force and effect for purposes of selling the former
City Hall, the legal description of said real estate being as follows:
Lot Eight (8), Block Sixty Six (66), Original Town Addition, Grand Island, Hall County,
Nebraska.
BE IT FURTHER RESOLVED, that in accordance with Neb. Rev. Stat. 16-202, that
the former City Hall shall not be sold for a period of one year after August 13,2001, the date on
which the remonstrance was filed with the governing body of the City.
