08/28/2001 Resolutions 2001-219 I I I RESOLUTION 2001-219 WHEREAS, the City of Grand Island, is the holder of a Perpetual Conservation Easement over, under, upon and across the following described real property: The Northeast Quarter of the Northeast Quarter (NE1I4, NE1I4) of Section 28, Township 10 North, Range 9 West ofthe 6th P.M. in Hall County, Nebraska; and Lot 1, Mainland of Section 21, Township 10 North, Range 9 West of the 6th P.M., Hall County, Nebraska; and Government Lot 9 and the accretion thereto in Section 16, Township 10 North, Range 9 West of the 6th P.M. in Hall County, Nebraska. WHEREAS, Nebraska Public Power District (hereinafter "NPPD") intends to obtain an easement over, under, upon and across the above-described real property for the construction, operation, maintenance, inspection and removal of an electric transmission line; and WHEREAS, in consideration of the benefits to accrue to said real property and the covenants, conditions and agreements contained in the Subordination Agreement, NPPD agrees that its subsequent easement will be subordinate to the rights and privileges granted to the City by its easement dated June 18, 1999, recorded as Instrument No. 200002238 in the Office of the Register of Deeds, Hall County, Nebraska; and WHEREAS, the requested subordination is in the best interests of all parties. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the Mayor is hereby authorized and directed to execute a Subordination Agreement subordinating the above described easement as more particularly set out in the agreement.
