WHEREAS, a public utility easement is required by the City of Grand Island, from
Omaha Paper Stock Company, Inc., a corporation, and Luzenac America, Inc., a corporation, to
install, upgrade, maintain, and repair all public utilities including sewer; and
WHEREAS, a public hearing was held on February 6, 2001, for the purpose of
discussing the proposed acquisition of an easement and right-of-way through a part of the Northwest
Quarter of the Northeast Quarter (NWl/4, NEl/4) and in part of the Southwest Quarter of the
Northeast Quarter (SWI/4, NEI/4) of Section Fifteen (15), Township Eleven (11) North, Range
Nine (9) West of the 6th P.M. in the city of Grand Island, Hall County, Nebraska, the centerline of
said easement and right-of-way being more particularly described as follows:
First to ascertain the point of beginning; start at a point on the intersection of the east
line of said Northwest Quarter of the Northeast Quarter (NWl/4, NEl/4) with the
south right-of-way line ofD.S. Highway No. 30; thence running southerly, along and
upon the east line of said Northwest Quarter of the Northeast Quarter (NWl/4,
NEl/4) and along and upon the east line of said Southwest Quarter of the Northeast
Quarter (SWl/4, NEl/4), a distance of One Thousand Five Hundred Five and Seven
Tenths (1,505.70) feet; thence deflecting right 90000'00" and running westerly, a
distance of Seventy Seven and Seven Tenths (77.70) feet to the ACTUAL point of
beginning; thence running northerly, along and upon the centerline of said easement,
a distance of One Thousand Fifty Nine and Five Tenths (1,059.50) feet to a point
which is Seventy Nine and Four Tenths (79.40) feet west of (measured perpendicular
to) the east line of said Northwest Quarter ofthe Northeast Quarter (NWl/4, NEl/4).
The above-described easement and right-of-way containing 0.49 acres, more or less,
as shown on the plat dated January 4, 2001, attached hereto as Exhibit "A", and
incorporated herein by this reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Omaha Paper Stock Company, Inc., a
corporation, and Luzenac America, Inc., a corporation, on the above-described tract ofland.
