RESOLUTION 2001-186
WHEREAS, easements are required by the City of Grand Island, from the following
parties for the installation, upgrade, maintenance, and repair of Sanitary Sewer District No. 492; and
WHEREAS, a public hearing was held on July 24,2001, for the purpose of discussing the
proposed acquisition of an easement and right-of-way affecting the following tracts ofland:
Name Property Description
Eugene & Donna Cargill, husband A part of Lot 19, R & B Subdivision, being more particularly
and wife described as follows:
A tract ofland being the southerly Twenty One (21.0) feet of
the northerly Twenty Six (26.0) feet of Lot 19, R & B
Sanitary Sewer Easement Subdivision, except the westerly Eight (8.0) feet of the
northerly Twenty Six (26.0) feet being an existing easement.
Bradley & Donna Titman, husband A part of Lot 23, R & B Subdivision, being more particularly
and wife described as follows:
A tract of land Ten (10.0) feet in width lying north of and
adjacent to the south line of Lot 23, R & B Subdivision and a
Sanitary Sewer Easement tract of land Ten (10.0) feet in width lying northwesterly of
and adjacent to the southeasterly line of Lot 23, R & B
Subdivision, beginning at the southwest comer of said Lot 23;
thence running easterly on the south line of said Lot 23 a
distance of Twenty Three (23.0) feet to the Actual Point of
Beginning; thence east a distance of Seventy Four and Forty
One Hundredths (74.41) feet to the one hundred (100.0) foot
radius point; thence continuing on the southeast line of said
Lot 23 a chord distance of 143.15 feet to the one hundred
(100.0) foot radius point lying Thirty Two and Forty One
Hundredths (32.41) feet south of the northeast comer of said
Lot 23.
Kyle & Shayla Nabity, husband and A part of Lot 13, R & B Subdivision, being more particularly
wife described as follows:
A irregular tract ofland adjacent to the south line of Lot 13, R
& B Subdivision, beginning at the southwest comer of said
Sanitary Sewer Easement Lot 13; thence running northeasterly on the west line of said
Lot 13, a chord distance of fifteen (15.0) feet; thence
continuing southeasterly on a line to a point on the southerly
line of said Lot 13, said point lying one hundred (100.0) feet,
southeasterly from the southwest comer of said Lot 13; thence
continuing northwesterly on the southerly line of said Lot 13,
a distance of one hundred (100.0) feet, to the southwest comer
of said Lot 13, being the point of beginning.

Parmley/Hellbusch, husband and wife described as follows:
An irregular tract ofland adjacent to the north line of Lot 20,
R & B Subdivision beginning at the northwest comer of said
Sanitary Sewer Easement Lot 20; thence running southwesterly on the west line of said
Lot 20, a chord distance of two and two tenths (2.20) feet;
thence continuing southeasterly on a line to a point on a line
eight (8.0) feet west of and parallel to the east line of said Lot
20; thence north on a line eight (8.0) feet west of and parallel
to the east line of said Lot 20, a distance of Twenty Eight and
Fifty Seven Hundredths (28.57) feet more or less to the north
line of said Lot 20; thence northwesterly along said north line
of Lot 20 to the point of beginning.
Grand West, L.L.C., a Nebraska A part of Lot Two (2), Ross Acres Subdivision, and a part of
Limited Liability Company the Southeast Quarter (SEl/4) of Section Eleven (11),
Township Eleven (11) North, Range Ten (10) West ofthe 6th
P.M., all in the City of Grand Island, Hall County, Nebraska.
Public Utilities Easement The centerline of the twenty (20.0) foot wide easement being
more particularly described as follows:
Beginning at the northeast comer of Lot Twenty Four (24),
Grand West Subdivision; thence running northerly along the
easterly right-of-way line of Craig Drive, on an assumed
bearing ofNOooOO'OO"E, a distance of Fourteen (14.0) feet, to
the Actual Point of Beginning and to Reference Point "A";
thence running N86054'00"E, a distance of Two Hundred
Ninety Six (296.0) feet, to Reference Point "B"; thence
running N90000'00''E, a distance of Sixty Two (62.0) feet to a
point oftermination. Beginning at Reference Point "B"; thence
running N02005'02"W, a distance of One Hundred Eighty Two
(182.0) feet, to a point of termination, said tract containing
0.243 acres more or less.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized
to acquire easements from the parties identified above on the above-described tracts of land.
