06/26/2001 Resolutions 2001-172 I I I RES 0 L UTI 0 N 2001-172 WHEREAS, on August 29,2000, the Mayor and City Council of the City of Grand Island approved a Conditional Use Permit for Omaha Paper Stock Co., Inc. (Omaha Paper) to operate a paper and cardboard recycling, loading, warehouse and shipping business at 1215 East Highway 30 in Grand Island, Hall County, Nebraska; and WHEREAS, Section 36-35 ofthe Grand Island City Code (1988 ed.) (Code) provides for the M2-Heavy Manufacturing Zone applicable to Omaha Paper's premises and requires a Conditional Use Permit for the intended use; and WHEREAS, the Conditional Use Permit was issued with certain conditions including no outside storage of collected paper or other material unless such material is surrounded by a site- obscuring fence and precautions to prevent/control loose debris on the premises; and WHEREAS, Omaha Paper has failed to comply with the foregoing conditions with the result that their business operations have proven to be unsuitable for the location and continued operations are not in the public interest; and WHEREAS, Omaha Paper has failed to comply with Chapter 8 - Building, Chapter 16 - Fire Protection, Chapter 17 - Garbage, Refuse, Waste, and Weeds, and Chapter 36 - Zoning of the Code in its operation of the paper and cardboard recycling, loading, warehouse and shipping business with the result that the City has been required to continually monitor and inspect the business premises, and enforce compliance with the Code. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the Conditional Use Permit approved by the Mayor and City Council on August 29, 2000 for Omaha Paper Stock Co., Inc. to operate a paper and cardboard recycling, loading, warehouse and shipping business at 1215 East Highway 30, Grand Island, Hall County, Nebraska, should be and hereby is revoked forthwith. BE IT FURTHER RESOLVED, that Omaha Paper Stock Co., Inc., shall cease all uses at 1215 East Highway 30 which are not in compliance with Section 36-35 of the Grand Island City Code (1988 ed.).
