WHEREAS, for many years, the City of Grand Island Downtown Development
Department leased land used as a parking lot at Pine Street and South Front Street from the Union
Pacific Railroad Company (UPRR); and
WHEREAS, in November, 2000, the City was verbally notified that UPRR would
be terminating its lease with the City; and
WHEREAS, the property is now leased by UPRR to Sprint Communications
Company L.P. (Sprint), and Sprint will develop a pocket park with benches, plantings, and lighting
on the southwest comer of this lot in order to enhance the entrance to the downtown area; and
WHEREAS, the City's Downtown Development Division has agreed to maintain such
pocket park; and
WHEREAS, an fudemnification Agreement is necessary between Sprint and the City
to indemnify both parties from claims by a third party for injury, loss or damage arising from use of
the property.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the fudemnification Agreement by and
between the City of Grand Island and Sprint Communications Company L.P. is hereby approved;
and the Mayor is hereby authorized and directed to execute such agreement on behalf of the City of
Grand Island.
