RESOLUTION 2001-137
WHEREAS, an initiative petition for a one-half cent sales tax for creating an
endowment for the City has been filed with the City Clerk and the signatures thereon verified by the
Hall County Election Commissioner; and,
WHEREAS, the District Court of Hall County, Nebraska, in an action captioned Alan
Sydow, Relator vs. City of Grand Island, Nebraska, a Municipal Corporation; Joyce Haase; Margaret
Hornady; Gale Larson; Glen Murray; Jackie Pielstick; Larry Seifert; Bob Sorensen; Scott Walker;
Tom Ward; Fred Whitesides, City Council Members, and RaNae Edwards, City Clerk, Respondents,
Case. No. CIOO-IIOO, found that the above referenced initiative petition contained sufficient
signatures to submit the question of the one-half cent sales tax as set forth in the initiative petition
at the next primary, general or special election as allowed by law and has issued an alternative writ
of mandamus directing that the Respondents act or in the alternative appear before the Court on May
23, 2001, at 11 :45 a.m. to show cause why they refuse to do so; and,
WHEREAS, the Mayor and City Council wish to conform to the order ofthe District
Court and the alternative Writ of Mandamus by placing this issue before the voters of the City of
Grand Island for their decision at the statewide primary election of May 14, 2002, reserving the
City's right to appeal the decision ofthe Court in the manner and form provided by law.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA:
(1) Pursuant to Neb. Rev. Stat. S32-559, in lieu of a separate special election, the following
ballot shall be submitted at the statewide primary election on May 14, 2002:

Sales and Use Tax Proposal:
Shall the Mayor and City Council of the City of Grand Island, Nebraska, impose a
sales and use tax in the amount of one-half percent (112%) in addition to the one
percent (1 %) currently in effect, upon the same transactions within the City of Grand
Island on which the State of Nebraska is authorized to impose a tax and shall the City
of Grand Island increase its budgeted restricted funds for fiscal year 2002-2003 by
$4,500,000 over the current year's restricted funds with the proceeds collected

therefrom to be used specifically for funding an endowment for the City's General
Fund.
