05/22/2001 Resolutions 2001-136 I I I RESOLUTION 2001-136 WHEREAS, on August 29, 2000, the Mayor and City Council approved a Conditional Use Permit for Omaha Paper Stock Company, Inc. (hereinafter "OPS") to operate a paper and cardboard recycling, loading, warehouse, and shipping business at 1215 East Highway 30, Grand Island, Hall County, Nebraska; and WHEREAS, said facilities were previously operated by Central Waste Disposal pursuant to a Conditional Use Permit issued on June 16, 1995; and WHEREAS, a Conditional Use Permit may be maintained for so long as the activity subject to the permit is operated in a lawful manner and not contrary to the interests of the public; and WHEREAS, the Conditional Use Permit for OPS provided certain conditions including: (1) There shall be no outside storage of collected paper or other material unless such material is surrounded by a site-obscuring fence. (2) That the provisions of the new landscaping ordinance shall be required and installed by the owner within six months of completion of the highway construction adjacent to the property. (3) That precautions should be provided to prevent/control loose debris on the property. WHEREAS, the operation of the premises ofOPS have violated Subparagraphs (1) and (3) above by failing to erect a site-obscuring fence, storing paper and other material outside, and allowing loose debris to be windborne from OPS property to neighboring private and public property in substantial quantities in violation of the Grand Island City Code, Chapter 17 [Garbage, Refuse, Waste, and Weeds] and Chapter 36 [Zoning]; and WHEREAS, termination of the Conditional Use Permit previously granted to OPS is necessary and prudent to protect the public health, safety and welfare, and to ensure compliance with the Grand Island City Code. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the Conditional Use Permit issued to Omaha Paper Stock Company, Inc. on August 29, 2000 is hereby revoked effective forthwith. BE IT FURTHER RESOLVED, that the office of City Attorney is authorized and instructed to take whatever steps are necessary to bring the premises at 1215 East Highway 30, Grand Island, Hall County, Nebraska into compliance with the provisions of the Grand Island City Code.
