RESOLUTION 2001-10
WHEREAS, Street Improvement District No. 1236 was created by Ordinance No.
8642 on December 5,2000; and
WHEREAS, notice ofthe creation of such street improvement district was published
in the Grand Island Independent on December 12, December 19, and December 26, 2000, in
accordance with the provisions of Section 16-619, RRS. 1943; and
WHEREAS, Section 16-620, RR.S. 1943, provides that if the owners of record title
representing more than 50% of the front footage of the property abutting upon the streets, avenues,
or alleys, or parts thereof which are within such proposed district shall file with the City Clerk within
twenty days from the first publication of said notice written objections to such street improvement
district, said work shall not be done and the ordinance shall be repealed; and
WHEREAS, the protest period ended on January 1, 2001, and one protest was filed
with the City Clerk against the creation of Street Improvement District 1236 representing 12.5% of
the total district frontage.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that insufficient protests having been filed with
the City Clerk against the creation of Street Improvement District No. 1236, such district shall be
continued and constructed according to law.
