10/24/2000 Resolutions 2000-325 I I I RES 0 L UTI 0 N 2000-325 WHEREAS, Chevron U.S.A. mc., a Pennsylvania Corporation, successor by merger to Chevron Chemical Company, a Delaware Corporation, has expressed an interest in donating to the City of Grand Island a tract of land, commonly known as the Chevron land, bordering Sucks Lake; and WHEREAS, a public hearing was held on October 24, 2000, for the purpose of discussing the proposed acquisition of such donated property comprising a part of the Northwest Quarter (NWY4) of Section Twenty One (21), Township Eleven (11) North, Range Nine (9) West of the 6th P.M. in the City of Grand Island, Hall County, Nebraska; such property being more particularly described as follows: Beginning at the southwest corner of the Southeast Quarter of the Northwest Quarter (SE ~ NW ~) (as laid out by County Surveyor Baldwin in 1890 and since used as such); thence running S 88052'24" E (assumed bearing) along and upon the south line of said Northwest Quarter (NW~), a distance of 224.98 feet to the intersection with the northerly right-of-way line of the Burlington Northern Railroad Company (belt line); thence N 61033'24" E along and upon said railroad right-of-way line a distance of 488.45 feet; thence S 28030'35" E, a distance of 24.97 feet; thence N 61032'26" E along and upon said railroad right-of-way line a distance of 195.47 feet; thence N 28006' 36" W, a distance of 354.17 feet to a point that is 300.0 feet south of the southerly line of Anna Street; thence S 62001' 17" W, parallel with the south line of Anna Street, a distance of 128.92 feet to a point on the easterly line of Broadwell Avenue; thence S 27045'31" E along and upon the easterly line of Broadwell A venue, a distance of 30.57 feet to its intersection with the southerly line of Oklahoma Avenue; thence S 60052'38" W along and upon the southerly line of Oklahoma Avenue, a distance of 654.44 feet to a point on the west line of said Southeast Quarter of the Northwest Quarter (SE~ NW~); thence S 0000'00" W along and upon the west line of said Southeast Quarter of the Northwest Quarter (SE ~ NW ~ ), a distance of 206.21 feet to the point of beginning and containing 5.732 acres, more or less, of which 0.163 acres, more or less, is presently occupied by public road right-of-way. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire the above-described tract ofland as a donation from Chevron U.S.A. me., a Pennsylvania Corporation, successor by merger to Chevron Chemical Company, a Delaware Corporation as set out in the Donation Agreement and Joint Escrow mstructions. City Attorney I I I BE IT FURTHER RESOLVED, that a Donation Agreement and Joint Escrow Instructions be entered into between the parties for such donated property; and the Mayor is hereby authorized and directed to sign such document on behalf of the City of Grand Island.
