WHEREAS, a public utility easement is required by the City of Grand Island, Ernest
J. Thayer and Janice M. Thayer, husband and wife, to install, upgrade, maintain, and repair power
appurtenances, including lines and transformers; and
WHEREAS, a public hearing was held on October 24, 2000, for the purpose of
discussing the proposed acquisition of an easement and right-of-way through a part ofthe Bast Half
of the Southeast Quarter (EYz SEY4) of Section Twenty Eight (28), Township Eleven (11) North,
Range Nine (9) West of the 6th P.M. in the City of Grand Island, Hall County, Nebraska; the
centerline of the twenty (20.0) foot wide easement and right-of-way being more particularly
described as follows:
Commencing at a point on the westerly line of Woodland First Subdivision, an
addition to the City of Grand Island, Nebraska, said point being three and thirty
one hundredths (3.31) feet north of the southwest corner of Lot Four (4) said
Woodland First Subdivision; thence westerly parallel to the northerly line of the
tract of land described in Document #87-105014, recorded in the Hall County
Register of Deeds Office, Grand Island, Nebraska; a distance of seven hundred
eight (708.0) feet to the Actual Point of Beginning; thence continuing westerly
along the last described course, a distance of one hundred seventy nine and fifty six
hundredths (179.56) feet, to a point ten (10.0) foot east of the westerly line of the
East Half of the Southeast Quarter (E1I2, SE1I4) of Section Twenty Eight (28),
Township Eleven (11) North, Range Nine (9) West; thence southerly parallel to the
East Half of the Southeast Quarter (E1I2, SE1I4) of said Section Twenty Eight
(28), a distance of six hundred sixty three and thirty one hundredths (663.31) feet
to a point on the northerly line of the Village Second Subdivision, being ten (10.0)
feet east of the northwest corner thereof.
The above-described easement and right-of-way containing a total of 0.39 acres,
more or less, as shown on the plat dated October 5, 2000, attached hereto as Exhibit
"A", and incorporated herein by this reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Ernest J. Thayer and Janice M. Thayer, husband
and wife, on the above-described tract of land.
