WHEREAS, a public utility easement is required by the City of Grand Island,
Nebraska from Michael 1. Myers and Jill A. Myers, husband and wife, for the purpose of installing
public utilities; and
WHEREAS, a public hearing was held on March 27, 2000, for the purpose of
discussing the proposed acquisition of an easement and right-of-way through a part of Lot Two (2),
Hidden Lakes Subdivision Number Eight (8), Hall County, Nebraska; the centerline ofthe twenty
(20.0) foot wide easement and right-of-way being more particularly described as follows:
Commencing at the northeast comer of the Northeast Quarter of the Northeast
Quarter (NE~ NE~), Section Thirteen (13), Township Eleven (11) North, Range
Nine (9) West of the 6th P.M.; thence southerly along the easterly line of the
Northeast Quarer of the Northeast Quarter (NE~ NE~), said Section Thirteen (13),
on an assumed bearing of S 00000'00" W, a distance of Thirty Eight (38.0) feet;
thence S 90000'00" W, a distance of Forty (40.0) feet to the Actual Point of
Beginning being a point Ten (10.0) feet south of the northeast comer of Lot Two (2),
Hidden Lakes Subdivision Number Eight (8); thence S 90000'00" W along a line
parallel with a northerly line of said Lot Two (2), a distance of Three Hundred One
and Eighty One Hundredths (301.81) feet to a point of deflection; thence continuing
N 45025'45" Wand parallel with a northeasterly line of said Lot Two (2), a distance
of Thirty Three and Seventy Four Hundredths (33.74) feet to a point of deflection;
thence continuing S 89031'47" Wand parallel with a northerly line of said Lot Two
(2), a distance of Two Hundred Seventy Seven and Eighty Four Hundredths (277.84)
feet to a point of deflection; thence S 87028'49" W, a distance of Two Hundred
Eighty Three and Fifty One Hundredths (283.51) feet to a point of deflection; thence
S 08057'39" E along an easterly line of said Lot Two (2) and its extension, a distance
of Two Hundred Twenty (220.0) feet; excepting therefrom that part more particularly
described as follows: the westerly Ten (10.0) feet of the northerly One Hundred
Ninety and Six Hundredths (190.06) feet of Lot One (1), Hidden Lakes Subdivision
Number Eight (8), Hall County, Nebraska.
The above-described easement and right-of-way containing 0.47 acres, more or less,
as shown on the plat dated March 13, 2000, attached hereto as Exhibit "A" and
incorporated herein by this reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Michael J. Myers and Jill A. Myers, husband
and wife, on the above-described tract of land.
