08/27/2002 Ordinances 8760 I I * This Space Reserved for Register of Deeds * ORDINANCE NO. 8760 An ordinance to repeal Ordinance 6957; to reinstate the street which was vacated pursuant to Ordinance No. 6957; to repeal any ordinance or parts of ordinances in conflict herewith; and to provide for publication and the effective date of this ordinance. WHEREAS, on November 21, 1983, by Ordinance No. 6957, the City of Grand Island approved the vacation of a portion of the 60 foot wide street located between the south right-of-way line of U.S. Highway 30 and the north boundaries of Commercial Industrial Park Subdivision of part of Block 1, Nelsen Subdivision, and Block 2 of Nelsen Subdivision, conditioned upon the reservation of public utilities easements; and WHEREAS, this Frontage Road has continued to be utilized by adjacent property owners and the public as a public street; and WHEREAS, it is suggested that Ordinance No. 6957 vacating such Frontage Road be vacated, and the Frontage Road be rededicated as a public street. That the portion of the Frontage Road referenced in Ordinance No. 6957 be rededicated as a public street. SECTION 3. Any ordinances or parts of ordinances in conflict herewith be, and hereby are, repealed. SECTION 4. This ordinance shall be in force and take effect from and after its passage and publication, within fifteen days in one issue of the Grand Island Independent as provided by law. Commercial Industrial Park Subdivision of Part of Block 1, Nelsen Subdivision, and Block 2 of Nelsen Subdivision, lying between Webb Road and Industrial Lane, be, and hereby is vacated; provided and conditioned that the City of Grand Island hereby reserves the northerly 15 feet of such street for a permanent easement for the placement, replacement, installation, and maintenance of a water main and all necess- ary appurtenances thereto; and the southerly 25 feet of the 60 foot wide street for a permanent easement for the place- ment, replacement, installation, and maintenance of a sani- tary sewer main, and all necessary appurtenances thereto, and all rights and privileges necessary for such enjoyment, all as shown on the plat marked Exhibit "A" attached hereto and incorporated herein by reference. No improvements, structures, or buildings of any kind whatsoever shall be allowed in, upon, or over the easements herein retained. SECTION 2. That the title to the portions of the street vacated by Section 1 of this ordinance shall remain in the name of the City of Grand Island, Nebraska. SECTION 3. That this ordinance, with the plat, is hereby directed to be filed in the office of the Register of Deeds, Hall County, Nebraska. I ORDINANCE NO. 6957 (Contd) SECTION 4. This ordinance shall be in force and take effect from and after its passage and publication without the plat within fifteen days in one issue of the Grand Island Daily Independent.
