10/23/2001 Ordinances 8702 I * This Space Reserved for Register of Deeds * I I ORDINANCE NO. 8702 An ordinance creating Water Main District No. 434T in the City of Grand Island, Hall County, Nebraska; defining the boundaries of the district; providing for the laying of water mains in said district; providing for plans and specifications and securing bids; providing for the connection fee for connecting to such water main; providing for certification to the Register of Deeds; and providing the effective date hereof. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: SECTION 1. Water Main District No. 434T in the City of Grand Island, Nebraska, is hereby created for the laying of twenty (20) inch diameter water mains with appurtenances in a part of the Southeast Quarter (SEl/4) of Section Thirty Two (32), Township Eleven (11) North, Range Nine (9) West of the 6th P.M. and a part ofthe Northeast Quarter (NEl/4) of Section Five (5), Township Ten (10) North, Range Nine (9) West of the 6th P.M., all in the city of Grand Island, Hall County, Nebraska. - 1 - A .., /1~- pproved as to Form t......- October 19, 2001 ... The boundaries of such water main connection district are as follows: Beginning at the northeast comer ofthe Northeast Quarter (NE 1/4), Section Five (5), Township Ten (10) North, Range Nine (9) West of the 6th PM, Hall County, Nebraska; thence southerly along the easterly line ofthe Northeast Quarter (NE 1/4) said Section Ten (10), a distance of one hundred fifty (150.0) feet; thence westerly, parallel with the northerly line of the Northeast Quarter (NE 1/4) said Section Ten (10), to a point on the easterly line of Platte Valley Industrial Park Third Subdivision in the City of Grand Island, Nebraska; thence northerly along the easterly line of said Platte Valley Industrial Park Third Subdivision and the easterly line of Scheel's Subdivision in Hall County, Nebraska, a distance of three hundred (300.0) feet; thence easterly, parallel with the southerly line of the Southeast Quarter (SE 1/4), Section Thirty-Two (32), Township Eleven (11) North, Range Nine (9) West of the 6th PM, Hall County, Nebraska, to a point one-hundred fifty (150.0) feet westerly of the easterly line of the Southeast Quarter (SE 1/4) said Section Thirty-Two (32); thence southerly, parallel with the easterly line ofthe Southeast Quarter (SE 1/4) said Section Thirty-Two (32), a distance of one hundred fifty (150.0) feet to a point on the southerly line of the Southeast Quarter (SE 1/4), said Section Thirty-Two (32); thence easterly along the southerly line ofthe Southeast Quarter (SE 1/4) said Section Thirty- Two (32), a distance of one hundred fifty (150.0) feet to the point of beginning, as shown on the plat dated October 4,2001, attached hereto. SECTION 3. Said improvement shall be made in accordance with plans and specifications prepared by the Engineer for the City, who shall estimate the cost thereof. Bids for the construction of said water main shall be taken and contracts entered into in the manner provided by law. SECTION 4. The cost of construction of such water main connection district shall be reported to the City Council, and the Council, sitting as a Board of Equalization, shall determine benefits to abutting property by reason of such improvement pursuant to Section 16-6,1 03, R.R.S. 1943. The special benefits shall not be levied as special assessments but shall be certified by resolution of the City Council to the Hall County Register of Deeds. A connection fee in the amount ofthe special benefit accruing to each property in the district shall be paid to the City of Grand Island - 2 - Approved as to Form " ~ October 19, 2001 ... No property thus benefitted by water main improvements shall be connected to the water main until the connection fee is paid. The connection fees collected shall be paid either into the Water Surplus Fund or into a fund to be designated as the fund for Water Main District No. 434T for the purpose of creating a sinking fund for the payment of bonds. Payment of the cost of construction of Water Main District No. 434T may be made by warrants drawn upon the Water Surplus Fund. SECTION 5. This ordinance shall be in force and take effect from and after its passage, approval, and publication, without the plat, within fifteen days in one issue of the Grand Island Independent.
