06/26/2001 Ordinances 8681 I * This Space Reserved for Register of Deeds * ORDINANCE NO. 8681 An ordinance to vacate a portion of Lester Street from the western boundary of Lots Two (2) and Thirteen (13) east to the eastern boundary of Lot One (1), Bachman and Lester Subdivision; to authorize the conveyance of such vacated street to Wilson Concrete Company, an I Iowa corporalion; 10 retain easements upon such property; to provide the giving of notice of such conveyance and the terms thereof; to provide the right to file a remonstrance against such conveyance; to provide for filing this ordinance with the office of the Register of Deeds of Hall County; to repeal any ordinance or parts of ordinances in conflict herewith; and to provide for publication and the effective date of this ordinance. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: SECTION 1. That a portion of Lester Street from the western boundary of Lots Two (2) and Thirteen (13) east to the eastern boundary of Lot One (1), Bachman and Lester Subdivision, more particularly described as follows, as shown on the plat dated June 8, 2001, I marked Exhibit "A" attached hereto and incorporated herein by reference be, and hereby is, vacated, provided and conditioned that the City of Grand Island hereby retains an easement on r" Approved as to Form... City Attorney I I I ORDINANCE NO. 8681 (Cont.) such property for sewer, electric, storm drainage, gas, and other public utilities and all rights and appurtenances thereto: That portion of Closed Lester Street lying adjacent to the south line of Lots One (1) and Two (2), and lying adjacent to the north line of the easterly Two Hundred Twelve and Four Tenths (212.4) feet of Lot Thirteen (13) and the north line of Lot Fourteen (14), all in Bachman and Lester Subdivision, in the City of Grand Island, Hall County, Nebraska. SECTION 2. That the conveyance of the above-described property to Wilson Concrete Company, an Iowa corporation, is hereby authorized and approved. The consideration for such conveyance shall be One Hundred Fifty Dollars ($150.00). Conveyance shall be by Quit Claim Deed upon payment of the foregoing consideration subject to easements and encumbrances of record. SECTION 3. As provided by law, notice of such conveyance and the terms thereof shall be published for three consecutive weeks in the Grand Island Independent, a newspaper published for general circulation in the City of Grand Island. Immediately after the passage and publication of this ordinance, the City Clerk is directed and instructed to prepare and publish such notice. SECTION 4. Authority is hereby granted to the electors of the City of Grand Island to file a remonstrance against the conveyance of such within described real estate; and if a remonstrance against such conveyance signed by registered voters of the City of Grand Island equal in number to thirty percent of the register voters of the City of Grand Island voting at the last regular municipal election held in such City be filed with the City Council within thirty days of passage and publication of such ordinance, said property shall not then, nor within one year thereafter, be conveyed. - 2 - Approved as to Form T Gr June 22. 2001 ... The conveyance of the above-described property is hereby authorized, directed and confirmed; and if no remonstrance be filed against such conveyance, the Mayor shall make, execute and deliver to WILSON CONCRETE COMPANY, an Iowa corporation, a Quit Claim Deed for said property, and the execution of such deed is hereby authorized without further action on behalf of the City Council. SECTION 6. This ordinance is directed to be filed in the office of the Register of Deeds of Hall County, Nebraska. SECTION 7. This ordinance shall be in force and take effect from and after its passage and publication, without the plat, within fifteen days in one issue of the Grand Island Independent as provided by law.
