ORDINANCE NO. 8665
An ordinance creating Water Main District No. 439T in the City of Grand Island,
Hall County, Nebraska; defining the boundaries of the district; providing for the laying of water
mains in said district; providing for plans and specifications and securing bids; providing for the
connection fee for connecting to such water main; providing for certification to the Register of
Deeds; and providing the effective date hereof.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
GRAND ISLAND, NEBRASKA:
SECTION 1. Water Main District No. 439T in the City of Grand Island, Nebraska,
is hereby created for the laying of sixteen (16) diameter water mains with appurtenances in a part of
Greenscape Inc. Subdivision, and a part of the Northeast Quarter of the Northwest Quarter of
(NEl/4, NWl/4) of Section Eight (8), Township Ten (10) North, Range Nine (9) West of the 6th
P.M. in Hall County, Nebraska, and a part of the Northwest Quarter of the Northwest Quarter
(NWl/4, NW1I4) of Section Eight (8), Township (10) North, Range Nine (9) West of the 6th P.M.
in Hall County, Nebraska.

SECTION 2. The boundaries of such water main connection district are as follows:
I
Beginning at the southeast comer of Platte Valley Industrial Park Third Subdivision;
thence northerly along the easterly line of said Platte Valley Industrial Park Third
Subdivision, a distance of forty (40.0) feet to a point on the northerly right-of-way
line of Wildwood Drive; thence westerly along the northerly right-of-way line of said
Wildwood Drive, a distance of two thousand five hundred sixty five and fifty three
hundredths (2,565.53) feet to the southwest comer of Lot One (1), Brennan
Subdivision; thence southerly along the westerly line of said Brennan Subdivision
and its extension, a distance of seventy three (73.0) feet to a point on the southerly
right-of-way line of said Wildwood Drive; thence westerly along the southerly right-
of-way line of said Wildwood Drive, a distance of fourteen and sixty-one hundredths
(14.61) feet; to a point on the easterly right-of-way line of US. Highway 34 and 281;
thence southerly along an easterly right-of-way line of said US. Highway 34 and 281,
a distance of three hundred twenty seven and eight tenths (327.8) feet; thence easterly
along a deflection in the right-of-way line of said US. Highway 34 and 281, a
distance of thirty five and one tenth (35.1) feet; thence southerly along an easterly
right-of-way line of said US. Highway 34 and 281, a distance of forty six and two
tenths (46.2) feet; thence easterly parallel with the northerly line of the Northwest
Quarter of the Northwest Quarter (NW 1/4, NW 1/4), Section eight (8), Township
Ten (10) North, Range Nine (9) West ofthe 6th PM, a distance of nine hundred forty
and six tenths (940.6) feet; thence southerly parallel with the easterly line of the
Northwest Quarter of the Northwest Quarter (NW 1/4, NW 1/4), said Section eight
(8), a distance of one hundred sixty five (165.0) feet; thence easterly parallel with the
northerly line of the Northwest Quarter ofthe Northwest Quarter (NW 1/4, NW 1/4),
said Section eight (8), a distance of three hundred twenty seven (327.0) feet to a point
on the easterly line of the Northwest Quarter ofthe Northwest Quarter (NW 1/4, NW
1/4), said Section eight (8); thence northerly along the easterly line of the Northwest
Quarter of the Northwest Quarter (NW 1/4, NW 1/4), said Section eight (8), a
distance oftwo hundred thirty nine (239.0) feet; thence easterly and three hundred
(300.0) feet distant and parallel with the northerly line of the Northeast Quarter ofthe
Northwest Quarter (NE 1/4, NW 1/4), said Section eight (8), a distance of one
thousand two hundred eighty one and twenty eight hundredths (1,281.28) feet; to a
point on the easterly line of the Northeast Quarter of the Northwest Quarter (NE 1/4,
NW 1/4), said Section eight (8); thence northerly along the easterly line of the
Northeast Quarter of the Northwest Quarter (NE 1/4, NW 1/4), said Section eight (8),
a distance of three hundred (300.0) feet to the southeast comer of said Platte Valley
Industrial Park Third Subdivision, being the point of beginning. Such district is
shown on the attached plat dated March 19,2001, attached hereto and incorporated
herein by reference.

SECTION 3. Said improvement shall be made in accordance with plans and
specifications prepared by the Engineer for the City, who shall estimate the cost thereof. Bids for
the construction of said water main shall be taken and contracts entered into in the manner provided
by law.
SECTION 4. The cost of construction of such water main connection district shall
be reported to the City Council, and the Council, sitting as a Board of Equalization, shall determine
benefits to abutting property by reason of such improvement pursuant to Section 16-6,103, R.R.S.
1943. The special benefits shall not be levied as special assessments but shall be certified by
resolution of the City Council to the Hall County Register of Deeds. A connection fee in the amount
of the special benefit accruing to each property in the district shall be paid to the City of Grand Island
I at such time as such property becomes connected to the water main in such district. No property thus
benefitted by water main improvements shall be connected to the water main until the connection
fee is paid. The connection fees collected shall be paid either into the Water Surplus Fund or into
a fund to be designated as the fund for Water Main District No. 439T for the purpose of creating a
sinking fund for the payment of bonds. Payment of the cost of construction of Water Main District
No. 439T may be made by warrants drawn upon the Water Surplus Fund.
SECTION 5. This ordinance shall be in force and take effect from and after its
passage, approval, and publication, without the plat, within fifteen days in one issue of the Grand
Island Independent.
