ORDINANCE NO. 8578
An ordinance to vacate a twenty (20.0) foot wide easement in the Southwest
Quarter of the Southwest Quarter (SW~ SW~) of Section Twenty Two (22), Township Eleven
(11) North, Range Nine (9) West of the 6th P.M., in Hall County, Nebraska; to provide for filing
this ordinance in the office of the Register of Deeds of Hall County; and to provide for
publication and the effective date of this ordinance.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
GRAND ISLAND, NEBRASKA:
SECTION 1. That the twenty (20.0) foot wide easement in the Southwest Quarter
of the Southwest Quarter (SW~ SW~) of Section Twenty Two (22), Township Eleven (11)
North, Range Nine (9) West of the 6th P.M., in Hall County, Nebraska, more particularly
described as follows:
The north Twenty (20.0) feet of the south Fifty Three (53.0) feet of the east Four
Hundred Thirty Six (436.0) feet of the said Southwest Quarter of the Southwest
Quarter (SW~ SW~), said easement containing 0.2 acres, more or less, as shown

on the plat attached hereto as Exhibit "A" and incorporated herein by this
reference;
is hereby vacated.
SECTION 2. The title to the property vacated by Section I of this ordinance shall
revert to the owner or owners of the real estate abutting the same in proportion to the respective
ownership of such real estate.
SECTION 3. Upon vacation of the above-described easement, any special
contractual arrangements between the City of Grand Island and the original Grantor(s), their
successors and assigns, shall survive this action to vacate said easement and shall be considered a
term and condition of the corrected public utility easement granted to the City in order to correct
the misalignment of the tracts and improvements.
SECTION 4. This ordinance is directed to be filed in the office of the Register of
Deeds ofRall County, Nebraska.
SECTION 5. This ordinance shall be in force and take effect from and after its
passage and publication, without the plat, within fifteen days in one issue of the Grand Island
Independent as provided by law.
