03/27/2000 Ordinances 8577 I * This Space Reserved for Register of Deeds * I I ORDINANCE NO. 8577 An ordinance to vacate a twenty (20.0) foot wide easement in the Northwest Quarter of the Southwest Quarter (NW'i4 SW'i4) of Section Twenty Seven (27), Township Eleven (11) North, Range Nine (9) West ofthe 6th P.M., in Hall County, Nebraska; to provide for filing this ordinance in the office of the Register of Deeds of Hall County; and to provide for publication and the effective date ofthis ordinance. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: SECTION 1. That the twenty (20.0) foot wide easement in the Northwest Quarter of the Southwest Quarter (NW'i4 SW'i4) of Section Twenty Seven (27), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., in Hall County, Nebraska, more particularly described as follows: A tract of land Twenty (20.0) feet in width lying Ten (10.0) feet on either side of a line parallel to and Eight Hundred Eighty Seven (887.0) feet east of the west line of said section, from the south line to the north line of said Northwest Quarter of the Southwest Quarter (NW'i4 SW'i4), and the south Twenty (20.0) feet of the Approved as to Form T ~ March 24, 2000 ... Y 1\ torney I I I ORDINANCE NO. 8577 (Cont.) east Two Hundred Seventeen (217.0) feet of the west Eight Hundred Seventy Seven (877.0) feet of said Northwest Quarter of the Southwest Quarter (NW'i4 SW'i4), said tract containing 0.7 acres, more or less, as shown on the plat attached hereto as Exhibit "A" and incorporated herein by reference; is hereby vacated. SECTION 2. The title to the property vacated by Section 1 of this ordinance shall revert to the owner or owners of the real estate abutting the same in proportion to the respective ownership of such real estate. SECTION 3. Upon vacation of the above-described easement, any special contractual arrangements between the City of Grand Island and the original Grantor(s), their successors and assigns, shall survive this action to vacate said easement and shall be considered a term and condition of the corrected public utility easement granted to the City in order to correct the misalignment of the tracts and improvements. SECTION 4. This ordinance is directed to be filed in the office of the Register of Deeds of Hall County, Nebraska. SECTION 5. This ordinance shall be in force and take effect from and after its passage and publication, without the plat, within fifteen days in one issue of the Grand Island Independent as provided by law.
