03/27/2000 Ordinances 8575 I * This Space Reserved for Register of Deeds * I I ORDINANCE NO. 8575 An ordinance to vacate a twenty (20.0) foot wide easement lying Ten (10.0) feet on either side of a line in Lot Twenty Five (25) of Matthews Subdivision in the City of Grand Island, Hall County, Nebraska; to provide for filing this ordinance in the office of the Register of Deeds of Hall County; and to provide for publication and the effective date of this ordinance. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: SECTION 1. That the twenty (20.0) foot wide easement lying Ten (10.0) feet on either side of a line in Lot Twenty Five (25) of Matthews Subdivision in the City of Grand Island, Hall County, Nebraska, more particularly described as follows: Beginning at a point on the southerly line of a parcel of land known as Thavenet Ice Pond Tract in the Northwest Quarter (NW~) of Section Twenty Seven (27), I Township Eleven (11) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, and Eight Hundred Eighty Five and Five Tenths (885.5) feet east of the west line of said section; thence running south on a line parallel to and Eight Hundred Eighty Five and Five Tenths (885.5) feet east of the west line of said section to the line between Lots Twenty Five (25) and Thirty Four (34) in said Approved as to Form" ~ March 24, 2000 ... Matthews Subdivision, said tract containing 0.1 acres, more or less, as shown on the plat attached hereto as Exhibit "B" and incorporated herein by this reference; is hereby vacated. SECTION 2. The title to the property vacated by Section 1 of this ordinance shall revert to the owner or owners of the real estate abutting the same in proportion to the respective ownership of such real estate. SECTION 3. Upon vacation of the above-described easement, any special contractual arrangements between the City of Grand Island and the original Grantor( s), their successors and assigns, shall survive this action to vacate said easement and shall be considered a term and condition of the corrected public utility easement granted to the City in order to correct the misalignment of the tracts and improvements. SECTION 4. This ordinance is directed to be filed in the office of the Register of Deeds of Ball County, Nebraska. SECTION 5. This ordinance shall be in force and take effect from and after its passage and publication, without the plat, within fifteen days in one issue of the Grand Island Independent as provided by law.
