03/27/2000 Ordinances 8571 I * This Space Reserved for Register of Deeds * I I ORDINANCE NO. 8571 An ordinance to vacate a portion of an easement located in the East Half of the Southwest Quarter (EYZ SWl;4) of Section Twenty Two (22), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., in Hall County, Nebraska; to provide for filing this ordinance in the office of the Register of Deeds of Hall County; and to provide for publication and the effective date of this ordinance. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: SECTION 1. That a twenty (20.0) foot wide permanent and perpetual easement located in the East Half of the Southwest Quarter (EYZ SWl;4) of Section Twenty Two (22), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., in Hall County, Nebraska, more particularly described as follows: To ascertain the point of beginning, commence at the northwest comer of said East Half of the Southwest Quarter (EYZ SWl;4); thence running south on the west line of said East Half of the Southwest Quarter (EYz SWl;4) for a distance of Eighty (80) feet; thence running east parallel to the north line of said East Half of Approved as to Form T ~ March 24, 2000 '" City Attorney I I I ORDINANCE NO. 8571 (Cont.) the Southwest Quarter (EYz SW'i4) for a distance of Ten (10) feet to the actual point of beginning; thence running south on a line parallel to the west line of said East Half of the Southwest Quarter (EYz SW'i4) to a point Five Hundred Forty Six and Five Tenths (546.5) feet north from the south line of said Section Twenty Two (22); thence running west on a line parallel to the south line of said Section Twenty-two (22) for a distance of Ten (10) feet to the west line of said East Half of the Southwest Quarter (EYz SW'i4); thence running south on the west line of said East Half of the Southwest Quarter (EYz SW'i4) for a distance of Twenty (20) feet; thence running east on a line parallel to and Five Hundred Twenty Six and Five Tenths (526.5) feet north from the south line of said Section Twenty Two (22) for a distance of Twenty (20) feet; thence running south on a line parallel to and Twenty (20) feet east from the west line of said East Half of the Southwest Quarter (EYz SW'i4) to a point Thirty Three (33) feet north from the south line of said Section Twenty Two (22); thence running east on a line parallel to and Thirty Three (33) feet north from the south line of said Section Twenty Two (22) for a distance of Ten (10) feet; thence running north on a line parallel to and Thirty (30) feet east from the west line of said East Half of the Southwest Quarter (EYz SW'i4) to a point Eighty (80) feet south from the north line of said East Half ofthe Southwest Quarter (EYz SW'i4); thence running west on a line parallel to the north line of said East Half of the Southwest Quarter (EYz SW'i4) for a distance of Twenty (20) feet, being the point of beginning, and containing one (1) acre more or less, as shown on the plat dated 6/7/65 attached hereto as Exhibit "A" and incorporated herein by this reference; is hereby vacated. SECTION 2. The title to the property vacated by Section 1 of this ordinance shall revert to the owner or owners of the real estate abutting the same in proportion to the respective ownership of such real estate. SECTION 3. Upon vacation of the above-described easement, any special contractual arrangements between the City of Grand Island and the original Grantor(s), their successors and assigns, shall survive this action to vacate said easement and shall be considered a term and condition of the corrected public utility easement granted to the City in order to correct the misalignment of the tracts and improvements. SECTION 4. This ordinance is directed to be filed in the office of the Register of Deeds of Hall County, Nebraska. - 2 - Approved as to Form T March 24, 2000 ...
