06/23/2026 Resolutions 2026-172 RESOLUTION 2026-172 RESOLUTION REGARDING APPROVAL OF A CONDITIONAL USE PERMIT LOCATED ON LOT 1 OF METTENBRINK HERITAGE SUBDIVISION. WHEREAS know all men by these presents, that Sasha Miller, the owner of parcel # 400186039 located at 6610 Saint Paul Road is requesting a conditional use permit to maintain and occupy the existing manufactured home as a temporary residence before being removed while a new modular home is installed and completed on a permanent foundation in the City of Grand Island Zoning Jurisdiction. WHEREAS, Single family residential uses are allowed within the AG-2: Secondary Agricultural Zone; and WHEREAS, the property is located at 6610 Saint Paul Road, lot 1 of Mettenbrink Heritage Subdivision, west of Saint Paul Road and south of Champman Road; and WHEREAS,the requested use is allowed as a conditional use as set forth in City Code Chapter Article 36- VI Conditional Use Permits; and, WHEREAS, the proposed conditional use is in the City's 2-mile Extraterritorial Zoning Jurisdiction; and, WHEREAS, the proposed conditional use is consistent with the City's Comprehensive Plan and Zoning Regulations, and is in an area which minimizes disruption to the health, welfare, and safety of the citizens of Grand Island; and, WHEREAS, all notice requirements of Grand Island City Code Chapter Article 36- VI Conditional Use Permits have been complied with; and, WHEREAS, the following terms and conditions have been proposed by the City: 1. USE: To maintain and occupy the existing manufactured home as a temporary residence while a new modular home is installed on a permanent foundation. 2. PRIMARY CONDITIONS: The permit may continue as long as the following conditions are met: a. A Building Permit is applied for within 90 days of approval of the conditional use permit. b. A demolition/moving permit is applied for before to or at the same time as the issuance of the certificate of occupancy. c. No trash, rubbish, debris, dead trees, lumber,bricks,refuse or junk material of any nature whatsoever shall be dumped,placed or located upon such real estate and must at all times be kept in a clean and neat condition. d. Applicant shall not use this real estate in any way to create or result in an unreasonable hazard or nuisance to adjacent landowners or to the general public. e. Applicant shall begin the construction within 120 days from the issuance of this permit, or if the applicant fails to begin construction within 120 days, the permit shall be considered null and void and subject to reapplication and rehearing. Additionally, if, at any time during the life of the permit, once issued,the operation ceases for a continuous period of 6 months,the permit shall become void, and a renewal shall be obtained before becoming operational again. f. Construction of the new dwelling is anticipated to take approximately 180 days (six months) to complete, with an expiration date for the conditional use permit of June 23, 2027, or within 90 days following the issuance of a certificate of occupancy for the new dwelling, whichever occurs first. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, grants the applicants request for a conditional use permit authorizing Sasha Miller to maintain and occupy the existing manufactured home as a temporary residence before being removed while a new modular home is installed and completed on a permanent foundation on lot 1 of Mettenbrink Heritage Subdivision(6610 Saint Paul Road),west of Saint Paul Road and south of Champman Road, that this use is granted upon passage of this resolution subject to subject to the terms and conditions set forth above.
