RESOLUTION REGARDING APPROVAL OF A CONDITIONAL USE PERMIT LOCATED
ON LOT 3 OF MEADOWLARK WEST FOURTH SUBDIVISION.
WHEREAS know all men by these presents,that Industrial Tower West,LLC,the owner of the
improvements on parcel#400208172 located on Part of Lot 1 Stuhr Museum Subdivision(3285 W
US Highway 34) is requesting a conditional use permit to construct and replace an existing 100-ft
monopole to improve the structure for the collocation of additional hardware from 3rd parties,
similar to its current use in the City of Grand Island Zoning Jurisdiction.
WHEREAS, Telecommunications Towers are allowed by Conditional Use Permit in the B 1:
Light Business Zone; and
WHEREAS,the property is located at 3285 W US Highway 34, Part of Lot 1 Stuhr Museum
Subdivision, east of US Highway 281 and south of US Highway 34; and
WHEREAS,the requested use is allowed as a conditional use as set forth in City Code Chapter
Article 36- XI Wireless Communication Towers; and,
WHEREAS, the proposed conditional use is in a developed area of the City's Municipal
Boundary; and,
WHEREAS, the proposed conditional use is consistent with the City's Comprehensive Plan
and Zoning Regulations, and is in an area which minimizes disruption to the health, welfare, and
safety of the citizens of Grand Island; and,
WHEREAS, all notice requirements of Grand Island City Code Chapter Article 36- XI
Wireless Communication Towers have been complied with; and,
WHEREAS, the following terms and conditions have been proposed by the City:
1. USE: Construct and replace an existing 100-ft monopole to improve the structure for the
collocation of additional hardware from 3rd parties, similar to its current use at 3285 W US
Highway 34.
2. PRIMARY CONDITIONS: The permit may continue as long as the following conditions
are met:
a. A demolition permit is required for the removal of the existing tower.
b. The height of the tower and all antennas shall not exceed 100 feet.
c. No tower shall be permitted to exceed 200 ft above the ground level of the
Central Nebraska Regional Airport's Runway if it is within 3 miles of said
runway.
d. The tower shall not interfere with any existing public easements.
e. All dead trees,rubbish,and debris,if any must be cleared from the real estate
as soon as practical and such real estate must,at all times,be kept in a clean
and neat condition.
f. No trash,rubbish, debris, dead trees, lumber,bricks,refuse or junk material
of any nature whatsoever shall be dumped,placed or located upon such real
estate.
g. Applicant shall not use the real estate in any way to create or result in an
unreasonable hazard or nuisance to adjacent land owners or to the general
public.
h. Applicant shall begin the operation within a period of 18 months from the
issuance of this permit,or if the applicant fails to begin operations within the
18 months, the permit shall be considered null and void and subject to
reapplication and rehearing. Additionally, if, at any time during the life of
the permit, once issued, the operation ceases for a continuous period of 6
months, the permit shall become void, and a renewal shall be obtained
before becoming operational again
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
GRAND ISLAND, NEBRASKA, grants the applicants request for a conditional use permit
authorizing Industrial Tower West, LLC to construct and replace an existing 100-ft monopole to
improve the structure for the collocation of additional hardware from 3rd parties, similar to its
current use on Part of Lot 1 Stuhr Museum Subdivision (3285 W US Highway 34), east of US
Highway 281 and south of US Highway 34,that this use is granted upon passage of this resolution
subject to subject to the terms and conditions set forth above.
