WHEREAS,a public utility easement is required by the City of Grand Island from JP
&PC of GI, LLC to survey, construct, inspect,maintain,repair,replace, relocate, extend,remove,
and operate thereon, public utilities and appurtenances, including power lines; and
WHEREAS, a public hearing was held on November 18, 2025, for the purpose of
discussing the proposed acquisition of a twenty(20.0)foot wide utility easement tract in part of Lot
Eleven (11), Commonwealth Business Park Third Subdivision and a part of Lot One (1),
Commonwealth Business Park Fourth Subdivision, in the City of Grand Island, Hall County,
Nebraska; the boundary.of the utility easement and right-of-way tract being more particularly
described as follows:
Commencing at the Southeast corner of Lot Eleven(11), Commonwealth Business
Park Third Subdivision,in the City of Grand Island,Hall County,Nebraska;thence
on an assumed bearing of N89°24'53"W,along the southerly line of said Lot Eleven
(11),a distance of fifty-eight and fifty hundredths(58.50)feet;thence N00°00'00"E,
a distance of eight(8.0)feet to a point on the northerly line of an existing eight(8.0)
foot wide easement, said point being the Point of Beginning; thence N89°24'53"W
along the northerly line of said existing eight(8.0)foot wide easement,a distance of
twenty(20.0)feet;thence N00°01'01"W,a distance of one hundred ninety-four and
twenty-seven hundredths (194.27) feet; thence N89°58'59"E, a distance of one
hundred one and forty-four hundredths (101.44) feet; thence N00°14'05"W, a
distance of sixty-eight and three hundredths (68.03) feet to a point on the southerly
line of an existing six (6.0) foot wide easement; thence S89°35'26"E, along the
southerly line of said existing six (6.0) foot wide easement, a distance of twenty
(20.0) feet; thence S00°14'05"E, a distance of sixty-seven and eighty-eight
hundredths(67.88)feet;thence N89°58'59"E,a distance of one hundred twenty-two
and fifty-six hundredths (122.56) feet; thence S00°01'01"E, a distance of twenty
(20.0)feet;thence S89°58'59"W,a distance of two hundred twenty-four(224.0)feet;
thence S00°01'01"E, a distance of one hundred seventy-four and forty-eight
hundredths (174.48) feet to the said Point of Beginning.
The above-described easement and right-of-way containing a total of 9,726.70 square
feet or.22 acres,more or less,as shown on the plat dated 10/21/2025,marked Exhibit
"A" and attached hereto and incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from JP & PC of GI, LLC on, over and below the
tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00)and mutual
benefits received.
BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to
execute all documents necessary to effect the purpose of this Resolution.
